بررسی مبانی مشروعیت یاعدم مشروعیت انواع روشهای لقاح مصنوعی در فقه و نظام حقوقی ایران

ناباروری یکی از قدیمی‌ترین مشکلات بشری است که از دیرباز سبب شده مبتلایان به آن ، دوره‌ای از زندگی خود را با انواع فشارهای عصبی بگذرانند و این مسئله موجب تلاش‌هایی برای دستیابی به راه‌حل‌های آن شده است. با پیشرفت دانش پزشکی، بسیاری از زوج‌های نابارور مشکل خود را با استفاده از روش‌های نوین باروری برطرف می‌کنند. یکی از مسائل مهم در قوانین فقهی، حقوقی و اجتماعی است ، و برخی از روش‌های جدید باروری گاه به‌گونه‌ای است که در نسب کودکان باعث ایجاد شبهه می‌شود لذا در این رساله تلاش می‌شود که نسب کودکان ناشی از این روش‌های باروری موردبحث و بررسی قرار گیرد. بررسی‌ها نشان می‌دهد که باوجود مخالفت پاره‌ای از فقها و صاحب‌نظران ، بیشتر صور لقاح مصنوعی، فاقد منع شرعی است و قول به جواز آن‌ها قابل دفاع به نظر می‌رسد و همچنین با مقمح نظر قرار دادن مصالح کودکان متولد از تلقیح مصنوعی و مشروع و قانونی دانستن نسب این کودکان ، می‌توان گام بزرگی در راستای رفع تبعیض و جلوگیری از مشکلات بعدی در جامعه اسلامی برداشت .

abstractinfertility is one of the oldest human problems that has long caused patients to spend a period of their lives with all kinds of stress, and this issue has led to efforts to find solutions. with the advancement of medical knowledge, many infertile couples solve their problem by using new methods of fertility. it is one of the most important issues in jurisprudential, legal and social laws, and some new methods of reproduction are sometimes such that it raises doubts about the lineage of children, so this paper tries to discuss the lineage of children resulting from these methods of reproduction. studies show that despite the opposition of some jurists and experts, most forms of artificial insemination are not prohibited by law and the promise of their permission seems defensible. these children can take a big step towards eliminating discrimination and preventing further problems in the islamic society.
