رابطه اخلاق و حقوق خانواده

اخلاق به مجموعه‌ای از اصول و ارزش‌ها اشاره دارد که رفتار انسان‌ها را تنظیم نموده و در صورتی که بر اساس تعالیم وحی استوار باشد، می‌تواند در جهت تحقق هدف وجودی انسان گام بردارد. احکام حقوقی در خانواده، تامین‌کننده حفاظت و امنیت خانواده به عنوان جزئی از جامعه است و موجبات بروز محبت، نظم و استواری خواهد شد. در نظام اخلاقی اسلام، تفاوت‌های طبیعی و حقوقی در راستای نیازها، کمبودها و استعدادهای انسانی می‌باشد. حقوق که با هدف تنظیم روابط اجتماعی و نظم در جامعه شکل گرفته است، برای بارور شدن خود و پیاده کردن اصول انسانی در ارتباطات اجتماعی به اخلاق نیاز دارد، زیرا ورود اخلاق به حیطه حقوق نه تنها اهداف علم حقوق را برهم نمی‌زند. بررسی نقش ارزشهای اخلاقی و قواعد حقوقی به عنوان یکی از اصلی‌ترین عناصر شکل‌دهنده در روابط حقوقی در خانواده محسوب می‌شود. ما در این تحقیق بر آن هستیم تا با بیان مفاهیم اخلاق، حقوق، ارزش‌های اخلاقی و قواعد حقوقی به ارتباط و تمایز اخلاق و حقوق در حقوق خانواده بپردازیم.

ethics refers to a set of principles and values which regulates human behavior and if it is based on the teachings of revelation, it can take steps towards the realization of the purpose of human existence. legal provisions in the family provide protection and security for the family as part of society and it will cause love, order and stability. in the moral system of islam, there are natural and legal differences in terms of human needs, shortcomings and talents. law formed with the aim of regulating social relations and order in society, it needs morality to be fertile and to implement human principles in social communication, because the entry of ethics into the field of law not only does not disrupt the goals of jurisprudence. examining the role of moral values and legal rules is considered as one of the main shaping elements in legal relations in the family. in this research, we seek to address the relationship and distinction between ethics and law in family law by expressing the concepts of ethics, law, moral values and legal rules
