مناسبات مبانی کلامی اسلامی و قانون اساسی جمهوری اسلامی ایران

در تعاملات میان حقوق با مبانی هستی‏ شناسانه و مبادی کلامی اسلامی این پرسش به میان می‌آید که آیا قانون اساسی صرفاً سند حقوقی محض است یا در بردارنده ارکان و عناصر جهان‌بینی جامعه‌ای است که قرار است بنیادهای آن را ترسیم نماید؟ تجربه قوانین اساسی نشان داده است که نمی‏توان از قانون اساسی انتظار داشت متنی خنثی در خصوص بنیان‏های فکری و هستی‌شناسانه آن دولت-کشور باشد. از همین‌رو قانون اساسی ایران نیز مبتنی بر ارکانی است که نمایانگر جهان‌بینی و آرمان‌های مردمان آن سرزمین است. از آنجا که قانون اساسی ج.ا.ا بر اساس مکتب اسلام به رشته تحریر درآمده است، مبانی کلامی اسلامی جایگاه ویژه‌ای را در آن به خود اختصاص داده است. مقاله حاضر، به مناسبات میان قانون اساسی ج.ا.ا و مبانی و عناصر هستی‌شناسانه و چارچوب‌های جهان‌بینانه که قانون اساسی در آن پارادایم‌ها تنظیم شده است - مانند توحید، عدالت و امامت - می‌پردازد و نشان می‌دهد که اولاً تدوین‌کنندگان قانون اساسی به این مناسبات توجه داشته‌اند و ثانیاً این مبانی و عناصر در ساحات ساختاری و هنجاری تاثیرگذار بوده و ثالثاً در مقام اجرا و حتی تفسیر قانون اساسی نیز، به این مناسبات توجه گردیده است.

in the interactions between law and the ontological foundations of islamic theology, the question arises as to whether the constitution is merely a purely legal document or contains the pillars and elements of the worldview of a society whose foundations are to be drawn. the experience of constitutions has shown that the constitution cannot be expected to be a neutral text on the intellectual and ontological foundations of that nation-state. therefore, the iranian constitution is based on pillars that reflect the worldview and aspirations of the people of that land. since the constitution of the islamic republic of iran is based on the school of islam, islamic theological principles have a special place in it. this article deals with the relationship between the constitution of the islamic republic of iran and the ontological foundations and elements and worldview frameworks in which the constitution is based on paradigms - such as monotheism, justice and imamate - and shows that first of all, the drafters of the constitution relations have paid attention, and secondly, these principles and elements have been influential in structural and normative areas, and thirdly, in the position of implementation and even the interpretation of the constitution, these relations have been considered.
