دلالت های فلسفی نظریه اعتباریات علامه طباطبایی ناظر بر نظریه حقوقی در تمدن اسلامی

نظریه اعتباریات علامه طباطبایی از مهم‌ترین ابداعات فلسفی ایشان به شمار رفته و نقش مهمی در سازمان نظام فکری ایشان و در مبانی فلسفی تمدن اسلامی ایفا می‌کند. این نظریه نکات مهمی در فهم فلسفی نظام های اعتباری داشته و دلالت های چهارگانه هستی‌شناسانه، معرفت‌شناسانه، انسان‌شاسانه و ارزش‌شناسانه در مورد مفاهیم و نظامات اعتباری به صورت عام دارد. با این پیش فرض که نظام حقوقی به عنوان یکی از ارکان تمدنی هر جامعه‌ای، یکی از مصادیق نظامات اعتباری است، دلالت های چهارگانه پیش‌گفته در مورد نظام حقوقی نیز به صورت خاص قابل طرح بوده و نتایج مهمی در سامان دادن نظریه حقوقی خواهد داشت. با توجه به آن‌چه مطرح شد، سوال پژوهش پیش‌رو این است که نظریه اعتباریات، چه دلالت های فلسفی اعم از دلالت‌های هستی‌شناختی، معرفت‌شناختی، انسان‌شناختی و ارزش‌شناختی را ناظر به نظریه حقوقیِ تمدن اسلامی داراست؟ روش انجام این پژوهش توصیفی-تحلیلی و مبتنی بر آثار علامه طباطبایی است. ناخودبسندگی گزاره‌های حقوقی، دخیل بودن عوامل سوبژکتیو در وضع، فهم و تفسیر قانون، عدم انحصار منابع شناخت قانون به منابع حسی، عدم تساوی حقوق با قانون و عدم تقلیل‌گرایی عدالت به نظم اجتماعی، عدم تناسب رویکرد رفتارگرایانه در علم حقوق از اهم نتایجی است که بر پژوهش حاضر مترتب است.
