بازکاوی دوران بین «نسخ و تخصیص»

از مسائل کاربردی و در‌عین‌حال بسیار پیچیده در علم اصول، بحث عام و خاص است که تاثیرات عمیق آن در علم فقه و همچنین حقوق به‌خوبی نمایان است. یکی از مسائلی که در بحث عام و خاص از قدیم‌الایام موجب معرکة آرا شده است، بحث دوران بین نسخ و تخصیص است. در این بحث که حالات گوناگون عام و خاص از قبیل مقارنت، تقدم، تاخر و یا جهل به تاریخ صدور آنها مورد بررسی قرار می‌گیرد، برخی از اندیشمندان اصول، در تمام فروض قائل به تخصیص عام به‌وسیله خاص هستند و بعضی از علما هم تفصیل داده و در برخی فروض قائل به نسخ و در برخی دیگر قول به تخصیص را پذیرفته‌اند. نگارنده در این نوشتار که به روش توصیفی تحلیلی انجام شده در پی پاسخ به این پرسش است که حالات مختلف بین نسخ و تخصیص به چه صورت است؟ که به نظر می‌رسد موارد آن با توجه به اختلاف مبانی، بسیار متعدد باشد. همچنین پس از طرح فروض و نقل اقوال علما به بررسی و بیان اشکالات آنها پرداخته و در نهایت به این نتیجه رسیده است که برخی از اختلاف‌ها فاقد ثمرۀ عملی بوده و در واقع نزاع‌ها لفظی است و برخی از فروض مانند تقدم خاص و تاخر عام از اساس اشتباه بوده و نیازمند بازنگری است.

re-examination of the rotation between abrogation and specification

one of the practical and yet very complex issues in the science of principles is the discussion of general and specific (’am wa khas), whose profound effects are well evident in the science of jurisprudence as well as law. one of the issues that has caused a battle of opinions in the discussion of general and specific since ancient times is the rotation between abrogation and specification. in this discussion, which examines various states of general and specific such as concurrence (moqarenat), precedence (taqaddom), delay (taakhor), or ignorance of their date of issuance, some scholars of principles argue for the specification of the general by the specific in all hypotheses, while some scholars have differentiated, accepting abrogation in some hypotheses and specification in others. the author, in this article which has been conducted through a descriptive-analytical method, seeks to answer the question: what are the different states between abrogation and specification? it seems that these cases are very numerous, considering the differences in foundations. also, after presenting the hypotheses and quoting the opinions of scholars, the author examines and states their problems, and finally concludes that some of the differences lack practical results and in fact, the disputes are verbal, and some hypotheses, such as the precedence of the specific and the delay of the general, are fundamentally mistaken and need revision.
