تاثیر فضای صدور روایات در فهم واژه‌ها و ترکیب‌واژه‌ها در راستای استنباط با تاکید بر آراء اصولی و فقهی آیت الله‌ نائینی (ره)

فهم واژه‌ها و ترکیب‌ واژه‌های روایات، اولین گام در فهم این گزاره‌هاست اما در این مسیر سوالی رخ می‌دهد که آیا فضای صدور روایات در این فهم نقشی دارد؟ آیا صرف لحاظ معنای موضوع لهِ واژگانِ کلام برای فهم معانیِ مفردات کفایت می‌کند؟ تحقّقِ صحیح این فهم، ممکن است عناصری را لازم داشته باشد از جمله آشنایی با فضای صدور که همراه صدور روایات، یعنی قرینه غیرلفظیه‌ای است. بی‌اعتنایی به این عنصر نقش‌آفرین، گاه مخاطب روایات را به بیراهه می‌برد؛ چراکه فهم ظهور عرفی و در پی آن، مراد متکلم، متّکی بر این قرائن است. همان‌طور که مرحوم نائینی می‌فرماید بدون توجه به قرائن روایات، استظهاری متفاوت از استظهارِ متکی بر قرائن، در ذهن شکل می‌گیرد. البته این بحث با جبران ضعف دلالت بسیار متفاوت است؛ به دیگر سخن، گاه قرائن، تعیین‌کننده ظهور عرفی هستند، چراکه ظهور یا به وضع است یا به قرینه. شایان بیان است تاثیر فضای صدور، منحصر به فهم معنای مفرداتِ روایات نیست بلکه افزون بر تاثیر در فهم صحیح مفردات مثل عام‌فهمیِ خاص‌نما، خاص‌فهمیِ عام‌نما، مقیَّدفهمیِ اطلاق‌نما، در فهم صحیح ترکیب‌واژه‌ها در عین وضوح معنای مفردات آن، از آثار توجه به فضای صدور است. این نوشتار درصدد است افزون بر طرح مباحث مربوط به استظهار با استقراء در کتب فقهاء و مصادر روایی، آثار توجه به فضای صدور روایات در فهم واژه‌ها و ترکیب واژه‌ها در راستای استنباط در دیدگاه فقها با تاکید بر نظرات اصولی و فقهی آیت‌الله محمدحسین نائینی; را بررسی و تحت عناوینی مشخص تبیین نماید.

understanding the words and phrases of narrations is the first step in comprehending these statements, but a question arises in this process: does the context of the issuance of narrations play a role in this understanding? is merely considering the literal meaning of the words sufficient for understanding the meanings of the individual words? the proper realization of this understanding may require elements such as familiarity with the context of issuance, which is a non-verbal circumstantial evidence accompanying the issuance of narrations. disregarding this influential element can sometimes lead the audience of narrations astray, because understanding the colloquial implication (zohur) and, consequently, the speaker’s intent relies on these circumstantial evidences, as naeini states. without considering the circumstantial evidences of narrations, a different implication from the one based on circumstantial evidences is formed in the mind. of course, this discussion is quite different from compensating for the weakness of the indication; in other words, sometimes circumstantial evidences determine the colloquial implication (zohure ’orfi) because implication is either based on wording or circumstantial evidence. it is worth mentioning that the impact of the context of issuance is not limited to understanding the meaning of individual words in narrations, but in addition to influencing the correct understanding of individual words, such as understanding a particular word as general, understanding a general word as particular, and understanding an unconditional word as conditional, it also affects the correct understanding of the combination of words despite the clarity of the meaning of their individual words, as a result of paying attention to the context of issance. this article aims, in addition to discussing the issues related to implication by induction in the books of jurists and narrative sources, to examine and elucidate under specific headings the effects of paying attention on the context of issuance of narrations in understandings words and phrases in the context of inference from the viewpoint of jursists, with an emphasis on the principles and jurisprudential views of ayatollah mohammad hosein naeini.
