تحلیلی بر اعمال قواعد خاص حل تعارض در مقررۀ رم2 اتحادیۀ اروپا و حقوق ایران

اعمال قاعدۀ حل تعارض یکسان در همۀ دسته‌های مسئولیت غیرقراردادی به نتایج نامطلوبی منجر خواهد شد. ازاین‌رو تدوین‌کنندگان مقررۀ رم2 اتحادیۀ اروپا (2007) در خصوص تعیین قانون قابل اعمال بر تعهدات غیرقراردادی در بند نوزدهم مقدمۀ آن تاکید کردند برای آن دسته از ضمانات قهری خاص که اعمال قاعۀه اصلی مادۀ 4 (قانون محل تحقق خسارت) در آنها مانع از تعادل و توازن منطقی میان منافع طرفین دعوا می‌شود، قواعد معینی مقرر شده است. بنابراین، مقررۀ رم2 در دسته‌های کوچک‌تر شبه‌جرم‌ها شامل مسئولیت ناشی از تولید، رقابت غیرمنصفانه، خسارت زیست‌محیطی، نقض حقوق مالکیت فکری، اعتصاب صنفی (اتحادیه‌ای) و همچنین برخی شبه‌عقدها به تعیین قاعدۀ خاص پرداخته است. در حقوق ایران قواعد حل تعارض خاصی برای الزامات خارج از قرارداد تدارک دیده نشده است. این مقاله با مداقه در قواعد حل تعارض مقررۀ رم‌2 و حقوق ایران به تحلیل آنها می‌پردازد.

An Analysis on the Application of Special Conflict Law Rules in the Rome II Regulation of European Union

The application of uniform conflict of law rules in all classes of noncontractual responsibility will result in undesired results. Therefore, The compositors of Rome II Regulation (2007) of European Union in the paragraph 19 of its preface emphasized that certain rules has been provided regarding the determination of applicable law on noncontractual obligation for those groups of special compulsory guarantees which the application of the original rules of article 4 (law of the place of injury) in them prevents from logical balances between the interests of disputed parties. Therefore, The Rome II Regulation has determined the special rules in small classes of torts including responsibility resulting from production, unfair competition, environmental injury, breach of intellectual property law, industrial action and some quasicontracts. This article will analyze them with examination on special conflict of law rules of Rome II regulation.
