تحلیل حقوقی ضرر اقتصادی ناشی از نقض اختراع و فرایند ارزش‌گذاری آن

تبیین مفهوم حقوقی ضرر اقتصادی ناظر بر نقض حق اختراع و روش ارزش‌گذاری میزان نقض وارده از مهم‌ترین مباحث مطروحه در نظام حقوقی مالکیت فکری است که تبیین آن می‌تواند راهگشای مشکلاتی از جمله تدارک معادل ریالی اختراع نقض‌شده در حوزۀ مسئولیت مدنی یا تعیین ارزش آوردۀ فکری مخترع در شرکت‌ها باشد. از منظر اقتصادی، توسعۀ اقتصادی، در گرو دسترسی به فناوری ارزشمند است، ازاین‌رو هرچه روش ارزش‌گذاری دقیق‌تر باشد، فرایند بهره‌برداری اقتصادی از اختراع پویاتر است. فرایند ارزش‌گذاری اختراع بسته به مرحلۀ گسترش آن متفاوت است، زیرا نیاز بهره‌وران به اختراع در مراحل مختلف ایجاد، توسیع و تجاری‌سازی آن، منتج به افزایش یا کاهش ارزش عرفی آن اختراع می‌گردد و این مهم متعاقباً نیاز به روشی متفاوت در ارزش‌گذاری اختراعات است. دستاورد اساسی این مقاله در وهلۀ اول تقسیم اختراعات به سه دستۀ کلی از حیث ارزش مالی آنها و تبیین روش حمایت حقوقی از هر کدام و در مرحلۀ دوم ارائۀ معیارهای دقیق ارزیابی آنها در صورت نقض و در مقام جبران خسارت مدنی وارده است. ازاین‌رو در تحقیق حاضر که تحقیقی کتابخانه‌ای با گرایش تحلیلی توصیفی است، بدواً مفهوم ضرر اقتصادیِ مرتبط با نقض حق اختراع و انواع نقض این دسته اموال فکری بررسی و متعاقباً راهکار ارزش‌گذاری حق اختراع در مراحل مختلف آن از حیث حقوقی و اقتصادی بررسی خواهد شد.

Legal Analysis of Economic Losses Due to Violation of the Invention and the Process of Its Valuation

The valuation of patent as an important part of intellectual property is one of the most important economic arguments in intellectual property rights and civil liability law that its explanation could lead to solving some problems such as compensating violated intellectual property. From the economical point of view, the country’s economic development depends on access to technology. Therefore, the more precise the method of valuation, the economic exploitation of intellectual property is more dynamic. The process of technology valuation varies depending on the stage of its diffusion, since the demand of the technology for the various stages of its creation, dissemination and commercialization results in the increase or decrease of the conventional value of technology and consequently the need for a different method in its valuation. In the present research, after dividing the technology into three stages of the first technology, prototype technology and commercialization technology, the valuation methods of each one will be analyzed and it will be argued that the use of appropriate valuation methods will increase the accuracy in determining the value of the Relevant technology. The method of this research is based on a descriptiveanalytic trendbased library approach. Information about the present study is compiled through the study of existing resources and after the study, necessary analyzes are presented in the form of legal thought.
