نقد و بررسی تحولات قانون ایران درخصوص تابعیت افراد متولد از مادران ایرانی (از قانون مدنی 1307 تا قانون 1398)

قانون ایران در خصوص تابعیت افراد متولد از مادران ایرانی، دستخوش تحولاتی شده است. با بررسی سیر اصلاح قوانین در این زمینه، درمی‌یابیم که قانونگذار در خصوص ترجیح «مصالح حاکمیتی و کلان جامعه» و «مصلحت افراد»، بر سر دوراهی قرار گرفته است؛ به ‌این‌ صورت که در برخورد با مسئلۀ تابعیت افراد متولد از مادران ایرانی، ابتدا به‌صورت مطلق، مصالح حاکمیتی خود را درنظر گرفته، اما با توجه به مشکلات ناشی از این رویکردِ مطلق و جزمی، قانونگذار (مجلس) و حتی دولت (قوۀ مجریه)، درصدد توجه به مصلحت افراد و استفاده از روش حقوقی و تحلیلی در برخورد با مسئلۀ تابعیت این افراد است؛ در پژوهش حاضر، نقاط ضعف و قوت تحولات و تلاش‌های متعدد قانونگذار و دولت به این مسئله، تبیین و تشریح شده است. نتایج این پژوهش، حاکی از آن است که هر دو رویکرد جزمی‌گرایی ابتدایی و تلاش‌های تحلیل‌گرایانۀ اخیر، با افراط‌گرایی‌هایی مواجه بوده است.

Review of developments in Iran’s law on the Nationality of Iranianborn mothers

Iran’s law on the Nationality of Iranianborn mothers has undergone some changes. By reviewing the process of amending the rules in this area we can get: The legislator has faced the dilemmaof the preference for macroeconomic and governance interests and people’s interests.So that in dealing with the issue of the Nationality of Iranianborn mothers, they first consider the absolute interests of their sovereignty, but due to the problems caused by this absolute and dogmatic approach by the legislator and even the government itself, it is considering paying attention to the interests of the people and the use of The legal and analytical method to deal with the issue of Nationality of these individuals. In this research, the weaknesses and strengths of various developments and efforts of the legislator and the government are explained and described. The results of this study indicate that both the initial dogmatic approach and the recent analytical efforts are facing extremism.
