بررسی قوانین رسیدگی به تخلفات اداری در سازمان اموزش و پرورش

همواره در زندگی بشری نیاز به نظم از نیاز های اساسی جوامع بوده، بنابراین این نیاز انسانها را ملزم به بکارگیری قوانین در زندگی فردی و اجتماعی خود کرده است. امروزه با گسترش جوامع و ایجاد سازمانهای بزرگ مانند اموزش و پرورش نیاز به قوانین و اجرای انها بیش از هر زمانی احساس می شود. مقاله حاضر با هدف تشریح و بررسی برخی قوانین مربوط به تخلفات اداری موجود در سازمان اموزش و پرورش جمهوری اسلامی ایران و نحوه مجازات انها سعی بر این دارد تا نقدی بر این قوانین داشته باشد. همه ما میدانیم که جرایم یا تخلفات ادارای دارای مجازات بخصوصی هستند، اما ایا در واقع این قوانین به درستی به مرحله اجرا میرسند؟ یا پرسشی که شاید ذهن بسیاری از ما را درگیر خود کرده باشد این است که ایا مجازاتهای تعیین شده در نص قانون متناسب با سنگینی تخلفات صورت گرفته هستند؟ همچنین، عدالت دیر هنگام، خود نوعی بی عدالتی است. پس، ساختار قضایی مطلوب، آن است که بستری شایسته را برای دادخواهی، رسیدگی و به طور کلی عدالت گستری به هنگام فراهم آورد. بنابراین عدم پیگیری سریع تخلفات اداری خود جز یکی از موارد بی عدالتی در اجرای احکام میباشد. بر اساس قانون رسیدگی به تخلفات اداری ، رسیدگی به تخلفات اداری که در سازمان ها و دستگاه های دولتی از جمله سازمان اموزش و پرورش اتفاق می افتد ، به عهده هیات های رسیدگی به تخلفات اداری است . این هیات ها شامل هیات های بدوی و هیات های تجدیدنظر می باشند که هیات عالی نظارت بر کارکرد آنها نظارت می نماید. در ادامه به بررسی شرح وظایف و مسیولیتهای این هییت میپردازیم.

in human life, the need for order has always been one of the basic needs of societies, so this need has forced people to apply laws in their personal and social lives. today, with the expansion of societies and the creation of large organizations such as education and training, the need for laws and their implementation is felt more than ever. this article aims to describe and review some laws related to administrative violations in the education and training organization of the islamic republic of iran and how to punish them, and tries to criticize these laws. according to the administrative violations law, handling administrative violations that occur in government organizations and institutions, including the education and training organization, is the responsibility of administrative violation boards. these boards include primary boards and appeal boards, whose work is supervised by the supreme supervisory board. in the following, we will examine the description of the duties and responsibilities of this committee. also, delayed justice is itself a form of injustice. therefore, the desired judicial structure is to provide a suitable platform for litigation, proceedings and in general justice in a timely manner. therefore, failure to quickly follow up administrative violations is one of the cases of injustice in the execution of sentences. we all know that crimes or administrative offenses have specific punishments, but are these laws actually enforced? or the question that may have occupied many of our minds is whether the punishments set in the text of the law are proportionate to the severity of the violations.
