کارکرد وقف در تحقق عدالت بین‌نسلی

عدالت سابقه‌ای به قدمت تاریخ بشر دارد. یکی از وجوه عدالت که اخیرا در افق دید انسان اهمیت پیدا کرده، «عدالت بین‌نسلی» است. یکی از راهکارهای تحقق عدالت بین‌نسلی در دین مبین اسلام، سنت نیکوی وقف است. ماهیت وقف بر‌استمرار و دوام مال موقوفه در طول زمان و استفاده نسل‌های بعدی از آن، دلالت می‌کند و با کارکرد‌های مختلفی که دارد از جمله: «صدقه جاریه» بودن، مصداق «الخیرات» بودن، تنوع در نیات متعالی واقفین، توسعه مالکیت عمومی، داشتن شرط دوام، عدم جواز بیع وقف الّا در موارد خاص و...»، عدالت بین‌نسلی را محقق می‌کند. این مقاله ابتدا به تعریف وقف و عدالت بین‌نسلی می پردازد و سپس با طرح انواع کارکردهای وقف در تحقق عدالت بین‌نسلی وقف را به عنوان یکی از راهکارهای عدالت بین‌نسلی معرفی نموده و با بهره گیری از آموزه های دینی و سیره پیامبر و معصومین: و همچنین تجارب تاریخی آن را به اثبات می رساند.

the function of endowment in realizing intergenerational justice

justice has a history as old as human history. one aspect of justice is intergenerational justice . intergenerational justice has recently become important in the horizon of human vision. in the religion of islam,, one of the ways to achieve intergenerational justice is the good tradition of endowment. the nature of the endowment is such that it indicates the continuity and durability of the endowment over time and for the use of the next generations. and the nature of endowment, with its various functions (including: being a current charity , being an example of al-khirat , diversity in the noble intentions of the endowment donors, development of public ownership, having a condition of stability, not allowing the sale of endowment except in special cases, etc.), brings about the realization of intergenerational justice. this article firstly defines the terms endowment and intergenerational justice. then, by examining the various functions of endowment in the realization of intergenerational justice, introduces the issue of endowment as one of the solutions of intergenerational justice. also, this article proves its historical experiences by using the religious teachings and life of the prophet and the innocents.
