   تحلیل شرط ضمان در عقد رهن با تاکید برقاعده فقهی (کل رهن فانه غیر مضمون)

چکیده    شرط ضمان در عقد رهن ، از مهمترین مباحث فقهی است که با توجه به قاعده فقهی (کل رهن فانه غیر مضمون)آراء و دیدگاههای مختلفی از سوی فقها بیان شده است . برخی از فقها قائل به بطلان این شرط هستند و برخی معتقدند این شرط خلاف مقتضای ذات عقد است و برخی هم چنین شرطی را صحیح می دانند. با توجه به اینکه پژوهش به صورت مروری و نظری است مقاله حاضر با بهره گیری از روش توصیفی تحلیلی و مبتنی بر روش کتابخانه ای و با استفاده از تحقیقات ، کتب ، اسناد و منابع کتابخانه ای مرتبط در صدد بررسی صحت و بطلان این نوع شرط با توجه به قاعده فقهی(کل رهن فانه غیر مضمون )می باشد. و درصدد اثبات این فرضیه هستیم که: که ادلۀ مخالفان برای اثبات بطلان این شرط ضمان در عقد رهن ناکافی است و این اشتراط با توجه به عمومات و اطلاقات ادله وجوب التزام به شروط، صحیح و التزام به آن واجب است
