واکاوی تطبیقی وضعیت حقوقی هوش مصنوعی در انعقاد قرارداد در حقوق ایران و ترکیه

با توجه به تحولات گسترده در عرصه فناوری و نفوذ روزافزون هوش مصنوعی در حوزه‌های مختلف زندگی، یکی از چالش‌های حقوقی جدید که به سرعت اهمیت یافته، تاثیر این فناوری بر فرآیند انعقاد قراردادهاست. این مقاله به واکاوی تطبیقی وضعیت حقوقی هوش مصنوعی در انعقاد قرارداد در حقوق ایران و ترکیه می‌پردازد. هدف اصلی تحقیق، بررسی چالش‌ها و فرصت‌های حقوقی مرتبط با استفاده از هوش مصنوعی در فرآیند انعقاد قراردادها و تحلیل چارچوب‌های قانونی موجود در هر دو کشور است. روش تحقیق به‌صورت توصیفی-تحلیلی و مبتنی بر مقایسه تطبیقی است. اهمیت این مطالعه در پاسخ به نیازهای فوری برای تدوین قوانین و مقررات نوین به‌منظور سازگاری با پیشرفت‌های تکنولوژیک نهفته است. یافته‌های اصلی تحقیق نشان می‌دهد که در حالی که ترکیه اقداماتی در جهت تصویب قوانین خاص برای هوش مصنوعی در قراردادها انجام داده است، حقوق ایران در این زمینه با خلا‌های قانونی و چالش‌هایی مواجه است. به‌ویژه، در ایران، مفاهیم حقوقی مرتبط با ظرفیت‌های جدید هوش مصنوعی به‌طور دقیق شفاف‌سازی نشده‌اند و در نتیجه این مسئله نیاز به بازنگری و تجدیدنظر در قوانین دارد. این مقاله با ارائه تحلیل تطبیقی و برجسته کردن تفاوت‌ها و شباهت‌ها میان دو نظام حقوقی، به شناسایی راهکارهایی برای ایجاد چارچوب‌های قانونی متناسب با تحولات جهانی در هر دو کشور می‌پردازد و به اهمیت اتخاذ رویکردی یکپارچه در این حوزه تاکید می‌کند.

a comparative analysis of the legal status of artificial intelligence in contract formation under iranian and turkish law

given the wide-ranging developments in technology and the growing influence of artificial intelligence (ai) in various aspects of life, one of the emerging legal challenges that has gained rapid significance is the impact of this technology on the process of contract formation. this paper explores the legal status of ai in contract formation in the legal systems of iran and turkey through a comparative approach. the main objective of this study is to examine the legal challenges and opportunities related to the use of ai in contract formation and analyze the existing legal frameworks in both countries. the research method is descriptive-analytical and comparative. the importance of this study lies in addressing the urgent need for the development of new laws and regulations to align with technological advancements. the main findings of the research indicate that while turkey has taken steps toward the adoption of specific ai laws for contracts, iran’s legal system faces legal gaps and challenges in this area. in particular, in iran, legal concepts related to the new capabilities of ai have not been adequately clarified, highlighting the need for a review and revision of existing laws. this paper, through a comparative analysis and by emphasizing the differences and similarities between the two legal systems, identifies solutions for creating legal frameworks that are aligned with global developments in both countries and stresses the importance of adopting a unified approach in this field.
