بررسی تطبیقی ضرورت مداخله قانونگذار کیفری در نظامهای حقوقی اسلامی و غیر اسلامی به معضل جهانی خشونت و زن ازاری در خانواده و اثرات این خشونت در بزهکاری کودکان

زمینه و هدف: محیط خانواده جامعه کوچک و جایگاهی است که فرد رشد جسمی و روانی خود را آغاز می‌کند. وضع محیط خانواده رابطه مستقیم با بروز حالات خطرناک و ارتکاب جرایم  در کودکان دارد. که بی‌توجهی به این موضوع باعث افزایش نرخ بزهکاری در کودکان می گردد. یافته‌ها : ازار و خشونت خانگی علیه زنان تاثیرات بس ناگوار و منفی بر روان اطفال باقی می‌گذارد، عوامل مختلفی بر خشونت  علیه زنان تاثیر گذاشته و سبب می‌گردد که زن محیط امن و آرامش روح و روان خود را از دست بدهد و به عنوان مادر نمی‌تواند مهر و محبت لازم را برای کودک خویش اعطا نماید. در نتیجه کودک از عواطف مادری محروم گشته و در تکوین شخصیت چنین کودکانی خلال وارد می‌شود. بازنگری در قوانین کشور یکی از راهکارها برای رفع خشونت خانگی بر زنان است. چرا که خشونت علیه زنان یک پدیدة شخصی نیست بلکه مشکل اجتماعی است که باعث سقوط انسانیت و اضمحلال خانواده‌ها و تباهی و بزهکاری کودکان می‌شود. نتایج: از نظر جرم  شناختی نبود حمایت‌های  کیفری لازم از زنان بزه دیده، باعث افزایش خشونت‌های خانگی نسبت به زنان شده و لازم است  قانونگذار کیفری علاوه بر جرم‌انگاری مستقل، دادرسی افتراقی با تاسیس دادگاه‌های ویژه یا آیین دادرسی ویژه برای زنان بزه دیده در نظر گیرد.

background and aim: the family environment is a small community and a place where a person begins his physical and mental development. the state of the family environment is directly related to the occurrence of dangerous situations and crimes in children. ignoring this issue will increase the crime rate in children. findings: domestic violence against women has a very negative effect on the psyche of children. various factors affect violence against women and cause women to lose their safe environment and peace of mind and cannot be as a mother. give the necessary love and affection to the child. as a result, the child is deprived of maternal emotions and interferes with the development of the personality of such children. reviewing the country’s laws is one of the ways to eliminate domestic violence against women. because violence against women is not a personal phenomenon but a social problem that causes the collapse of humanity and the destruction of families and the delinquency of children. results: from a criminological point of view, the lack of necessary criminal protection for women victims has led to an increase in domestic violence against women.
