نقش متقابل امنیت واستقلال باجرایم مطبوعاتی در اسلام وحقوق موضوعه

گرچه دربدو نظر مسئلۀ امنیت و استقلال و آزادی بیان و جرایم مطبوعاتی کم ارتباط می‌نماید، اما پس از بررسی و تحقیق معلوم می‌گردد که امنیت و استقلال از یک طرف و مسئلۀ آزادی بیان و جرایم مطبوعاتی، ارتباط بسیار عمیق و رابطۀ علت و معلول با یکدیگر دارند. یکی از دغدغه های مورد تایید شرع و عقل و قانون همواره پرهیز از هرج ومرج و تامین امنیت و استقلال بوده است و خواهد بود. لکن شیوه وروش حفظ امنیت و استقلال همواره دگرگون شده است. در زمان‌های گذشته غالباً ابزار حفظ امنیت و اسقلال وسایل نظامی بوده است و غالباً آزادی بیان و مطبوعات را مخل امنیت تلقی می‌نمودند. لکن در دهه‌های اخیر گرچه حدود و ثغور جرم‌انگاری درجرایم مطبوعاتی با رویکرد امنیت و استقلال اهمیت به‌سزایی یافته است ولی روش حداکثری تامین امنیت و حفظ استقلال ایجاد مشارکت عمومی و اعطاء آزادی بیان و اعمال آن از طریق رسانه و از آن جمله مطبوعات به‌حساب آمده است که این امر تا حدودی در ظاهر دارای تعارض است. دراین مقاله که با روش توصیفی و تحلیلی به این سوال اساسی که اساساً چه رابطۀ علی ، معلولی بین استقلال و امنیت از طرفی و آزادی‌های مشروع به‌خصوص آزادی بیان وجود دارد؟ پرداخته‌ایم. مهم‌ترین نتیجۀ تحقیق آن است که از منظر اسلامی و مستنداً به آیات قرآن کریم اساساً جلب مشارکت حداکثری مردم از طریق آزادی‌های مشروع علت‌العلل حفظ استقلال و امنیت کشور است و بین استقلال و امنیت رابطۀ علت و معلول برقرار است.

although the issue of security, independence, freedom of expression and press crimes are not related to each other, but after examination and research, it is clear that security and independence on the one hand, and the issue of freedom of expression and press crimes on the other hand, have a very deep connection and causal relationship with each other. one of the concerns approved by sharia, reason and law has always been avoiding chaos and ensuring security and independence, but the method of maintaining security and independence has always changed. in the past, military equipment was often used as a means of maintaining security and stability, and freedom of speech and the press were often considered a threat to security. however, in recent decades, although the limits of criminalization in press crimes have become very important for security and independence, the maximum method of creating security and preserving independence is public participation and freedom of expression and actions through the media, including the press, which is contradictory.in this article we have examined , this basic question & what is basically the causal relationship between independence and security on the one hand and legitimate freedoms, especially freedom of speech on the other hand? “ with a descriptive and analytical method.the most important result of the research is that from an islamic point of view and based on the verses of the holy qur’an, the maximum participation of the people through legitimate freedoms is the cause of maintaining the country’s independence and security, and there is a causal relationship between independence and security.
