حق مشارکت معلولان در ورزش‌های الکترونیکی و چالش دوپینگ: توازن میان انصاف و برابری

ورزش‌های الکترونیکی به‌عنوان یکی از شاخه‌های نوظهور ورزش‌های رقابتی، زمینه‌ساز مشارکت گسترده افراد دارای معلولیت شده است. این حضور، علاوه بر تحقق اصل برابری، چالش‌هایی را در حوزه انصاف رقابتی، استفاده از تجهیزات تطبیقی و دوپینگ الکترونیکی به‌وجود آورده است. از یک‌سو، مقاوله‌نامه حقوق افراد دارای معلولیت دولت‌ها را مکلف به تضمین مشارکت برابر این افراد در رقابت‌های ورزشی کرده و بر اصل عدم تبعیض تاکید دارد. از سوی‌دیگر، امکان ایجاد مزیت ناعادلانه ناشی از تجهیزات کمکی، ضرورت تبیین معیارهای حقوقی مشخص برای حفظ عدالت رقابتی را ایجاب می‌کند. این پژوهش با استفاده از روش تحلیل تطبیقی و بررسی رویه‌های دیوان داوری ورزش، ازجمله آرای صادره در پرونده‌های اسکار پیستوریوس و بلیک لیپر، به بررسی معیارهای حقوقی حاکم بر مشارکت افراد دارای معلولیت در رقابت‌های ورزشی و تفسیر اصل برابری در مواجهه با اصول انصاف رقابتی می‌پردازد. یافته‌های پژوهش نشان می‌دهد که فقدان مقررات روشن در زمینه تجهیزات تطبیقی و دوپینگ الکترونیکی در ورزش‌های الکترونیکی، موجب ایجاد تعارض میان اصل برابری و انصاف رقابتی شده است. درنتیجه، تدوین چهارچوب‌های قانونی مشخص، ایجاد نهادهای نظارتی مستقل و توسعه سازوکار‌های داوری تخصصی، به‌عنوان راهکارهای حقوقی جهت تضمین مشارکت عادلانه و جلوگیری از تبعیض در این حوزه پیشنهاد می‌شود.

as an emerging industry, e-sports is growing rapidly, with revenues projected to reach $5.7 billion by 2028. as the industry expands, people with disabilities have also found more opportunities to participate in these competitions. the use of adaptive equipment to improve their physical and cognitive abilities has helped them participate in e-sports, but this has faced challenges such as respecting the principles of “fairness” and “equality” in competitions. one of the challenges is cheating or “e-doping,” which can occur through the manipulation of equipment and software. examining the balance between fairness and equality in e-sports competitions for people with disabilities requires legal analysis within the framework of international law. this research examines the legal obligations of states under the “convention on the rights of persons with disabilities” and analyzes the decisions of the court of arbitration for sport in this regard. an analysis of the pistorius and lipper cases on assistive devices and competitive advantage illuminates the legal and ethical challenges in this area. this study emphasizes the need to strike a balance between securing the rights of people with disabilities and maintaining fair competition.
