ابعاد حقوقی نفرت پراکنی در فضای مجازی علیه جایگاه زنان در خانواده

خانواده اولین اجتماعی است که بشر در آن پای نهاده و علی‌‌رغم مفهوم ساده آن دارای روابط پیچیده‌‌ای است که حفاظت از آن منجر به رشد احساسات فردی اعضاء و درنهایت موجب پیشرفت جامعه خواهد شد. به همین دلیل حفظ بنیان خانواده و تحکیم روابط اعضای آن پیوسته باید مورد توجه بخش‌های مختلف حکومت قرار گیرد. امروزه پیشرفت فناوری، ایجاد و توسعه فضای مجازی علی‌رغم آثار مثبت، زمینه‌هایی برای نقض حقوق افراد حتی در محیط خانواده ایجاد کرده‌ است؛ برای‌مثال انتشار سخنان نفرت‌آمیز راجع به جنسیت زنان و نقش‌‌های ایشان در خانواده در فضای مجازی منجر به احساس ناکامی و انزجار در بانوان شده‌ است. بدین‌ترتیب دیدگاه افراد، نسبت به ارزش نقش‌‌هایی همچون همسری و مادری تنزل یافته و موجب فروپاشی خانواده و درنهایت منجر به ازهم‌‌گسیختگی جامعه خواهد شد. ازاین‌رو لازم است ابعاد حقوقی نفرت‌پراکنی در فضای مجازی علیه نقش و جایگاه زنان مورد مطالعه قرار گیرد تا الزامات حقوقی و بایسته‌های قانون‌گذاری مطرح شده و از ظرفیت موجود نظام حقوقی بیشترین استفاده برای حمایت از این قشر آسیب‌‌پذیر صورت پذیرد. در این پژوهش با روش توصیفی-تحلیلی، موضوع نفرت‌پراکنی علیه نقش‌‌های خانوادگی زنان، مطالعه و تلاش شده است وضعیت نظام حقوقی ایران در مواجهه با این آسیب تبیین گردد. به نظر می‌رسد به‌کارگیری تدابیر حقوقی در راستای ممنوعیت نفرت‌‌پراکنی ازجمله تنظیم‌گری، فیلترینگ و وضع قوانین پیشگیرانه و همچنین جرم‌انگاری رفتارهای نفرت‌‌آمیز و درنهایت استفاده از ظرفیت مسئولیت مدنی روش‌‌های مناسبی باشند.

the family isthe first society inwhich humans have set foot,& despite its simple concept,it has complex relationships,the protection of which will lead to the growth of the individual feelings of the members 7 ultimately lead to the progress of the society.for this reason,maintaining the foundation of the family & strengthening the relationships of its members should be given the attention of various government departments.today, theadvancement of technology,the creation and development of virtual space, despite its positive effects,has created grounds for violating people’s rights even inthe family environment.for example,the publication ofhateful words about women’s gender & their roles in the family in cyberspace has ledto afeeling of failure & disgust inwomen.in this way,people’s views on the value of roles such as wife & mother will bedegraded & will cause the collapse of the family & eventually lead to the disintegrationof the society.therefore,it is necessary to study the legal dimensions of spreading hate in virtual spaceagainst therole and position of women,so that the legal requirements and legislative requirements are raised and the existing capacity of the legal system can be used tosupport this vulnerable group. in this research,with descriptive-analytical method, the issue of spreading hatred against women’s family members has been studied and an attempt has been madetoexplain the situation of iran’s legal system in dealing with this harm.it seems that the use oflegal measures in order to ban hate speech,including regulation, filtering & theestablishment of preventive laws,as well asthe criminalization of hateful behaviors and finally using thecapacity ofcivil responsibility,are suitable methods
