مبانی و مستندات فقهی دفاع مشروع در جرایم منافی عفت در فضای مجازی

این مقاله به بررسی مبانی و مستندات فقهی دفاع مشروع در جرایم منافی عفت در فضای مجازی می پردازد. فضا ی مجازی، به عنوان یکی از مسائل مستحدثه، دارای ابعاد و آثار گوناگونی است که تاثیرات آن در زند گی فردی و اجتماعی فراوان بوده و با حقوق و تکالیف انسانها مرتبط است. در این میان، جرایم منافی عفت در فضا ی مجازی از اهمیت ویژه ای برخوردار است؛ لذا با پیشرفت فناوری ضروری است تدابیری اندیشید که مطالعات فقهی در این ارتباط نیز متناسب با آن گسترش یابد و پژوهش حاضر با هدف بررسی های فقهی، در پی دست یافتن به این مهم در زمینه دفاع مشروع در فضای مجازی می باشد. با استفاده از روش توصیفی-تحلیلی، این پژوهش پس از مفهوم شناسی دفاع مشروع، فضای مجاز ی و جرایم منافی عفت، به بررسی مصادیق این نوع دفاع شامل دفاع از حریم خصوصی و ناموس در فضای مجازی و همچنین مبانی و مستندات فقهی آن پرداخته است. نتایج نشان می دهد که دفاع مشروع در فضای مجازی با استناد به ادله عقلی، نقلی و قواعد فقهی مانند وجوب دفع ضرر، قبح معاونت بر اثم، قاعده اهم و مهم و قاعده عقلی احسان قابل اثبات است. همچنین فقها با استناد به آیات قرآن کریم و روایات، شرایط و موارد مشروعیت چنین دفاعی را تایید کرده اند.

legitimate defense in jurisprudence is one of the cases that excludes some criminal behavior from the guarantee and gives it legitimacy in the capacity of defense. the imami jurists have determined its necessity, limits, and gaps by relying on the rules of nature, reason, and citing the verses of the qur’an and the traditions of the ahl al-bayt (peace be upon them). one of the most important categories of legitimate defense is defense against chastity crimes. at present, cyberspace has provided a contaminated environment for committing this type of crime, and on the other hand, it has provided a suitable platform to defend against it. the findings of this research, written in a descriptive-analytical way, show that defense in cyberspace is possible and against some crimes against chastity that are committed with the intention of attacking one’s honor and dignity - by observing the jurisprudential conditions such as al-ashl, falasahl- it is possible to defend legitimately by hacking, sending malware to the aggressor’s subsidy and tools, counter-threat, etc.
