تبیین حکم فقهی اشاعه فحشا در فضای رسانه‌ای

یکی از ناهنجاری‌های اجتماعی، ترویج فواحش در جامعه است. در دوران فعلی، فضای‌ رسانه‌ای موجب تحقق این ناهنجاری در محدوده‌ای وسیع و با سرعت بالا شده است. آگاهی از احکام فروعات این مساله، نیازمند پاسخ به این سوال است که مبانی فقهی حکم اشاعه فواحش در فضای رسانه‌ای، نزد فقهای امامیه کدام است؟ پاسخ به این سوال سبب معرفی و دلالت ادله فقهی در راستای شناختن مبانی، با هدف تعیین وظایف کاربران رسانه‌ها، و تعیین رویکرد اجرایی دستگاه‌های نظارتی خواهد بود. در این نوشته به روش توصیفی و تحلیلی، بعد از بیان مفاهیم و اشاره به مراد از اشاعه فحشا، استدلال به ادله فقهی مورد بررسی قرار گرفته است. آیه سوره «نور» دلالت بهتری نسبت به دو آیه دیگر دارد. از روایات هم، حداقل چیزی که استفاده می‌شود حرمت افشا و اظهار معاصی می‌باشد، مخصوصا افشا و اظهار خطاها و گناهانِ شخصِ مسلمان می‌باشد. استدلال به اشاعه فاحشه بودنِ برخی از معاصی برای اثبات حرمت آن نیز بر مسلم بودن این حکم در بین فقها دلالت دارد. لازم آمدن گسترش ظلم و ضلالت در جامعه و مقدمه فساد بودن به عنوان دلیل عقلی، و ازهم‌گسیختگی و نابودی جوامع به سبب گسترش فساد نیز دلیل عقلایی بر ممنوعیت آن خواهد بود.

one of the social anomalies is the promotion of obscenity in the society. in the current era, the media environment has caused this anomaly to be realized in a wide range and at a high speed. knowledge of the rulings of this issue requires an answer to the question, what are the jurisprudential bases of the ruling on the dissemination of obscenities in the media space, according to imamiyya jurists? the answer to this question will lead to the introduction and implication of jurisprudential evidence in order to know the basics, with the aim of determining the duties of media users, and determining the executive approach of regulatory bodies. in this article, in a descriptive and analytical way, after explaining the concepts and referring to the meaning of the spread of prostitution, the argument based on jurisprudential evidence has been examined. the verse of surah noor has a better meaning than the other two verses. from the hadiths, at least the thing that is used is the sanctity of revealing and declaring sins, especially revealing and declaring the mistakes and sins of a muslim person. arguing that some sin is promiscuous in order to prove its sanctity also indicates the certainty of this ruling among jurists. the necessity of the spread of oppression and misguidance in the society and the introduction of corruption as a rational reason, and the disintegration and destruction of societies due to the spread of corruption will also be a rational reason for its prohibition.
