کاربرد هوش مصنوعی در حل مسائل حقوق خانواده

هوش مصنوعی در عرصه های مختلف، کارآمدی خود را به اثبات رسانده که حقوق و حل مسائل حقوقی نیز از این نفوذ مصون نمانده است که در عرصه های مختلف حقوقی کاربردهای عینی آن مشاهده شده و قابلیت های آتی نیز مورد بررسی است. یکی از این حوزه ها، مربوط به حقوق خانواده می باشد که حضور هوش مصنوعی بسیاری از مشکلات موجود در تصمیم گیری را می تواند به خوبی مدیریت و سازماندهی کند. حقوق خانواده که مباحثی مانند ازدواج، طلاق و فسخ نکاح، مسائل مالی ناشی از آن، سرپرستی و نگهداری فرزندان و کودکان را دربردارد، از مباحثی است که طولانی بودن روند تصمیم گیری و مراجعه به محاکم، آسیب های عاطفی و روانی آن را بیشتر کرده و روندی فرسایشی برای طرفین ایجاد می کند. کمک و حضور هوش مصنوعی علاوه بر اینکه دقت بیشتری در شناخت شخصیت و زمینه های اشتراک یا اختلاف افراد برای زندگی یا جدایی افراد دارد، در روند تصمیمات نیز می تواند موثر باشد تا دقت و سرعت بیشتری برای این قبیل پرونده ها همراه داشته و آسیب کمتری متوجه افراد و سلامت روانی آنها شده و احتمال اشتباهات در تصمیم گیری ها کاسته شود. کشورهای مختلفی نیز به این کاربردها توجه داشته اند که در این مقاله به عنوان کاربردهای عینی هوش مصنوعی در حل مسائل حقوق خانواده به آنها اشاره شده و قابلیت ها و قواعد به کارگیری آن در نظام حقوقی ایران بررسی می شود .

artificial intelligence has proven its effectiveness in various fields, and law and solving legal issues have not been immune from this influence, its concrete applications have been observed in various legal fields, and its future capabilities are also being investigated. one of these areas is related to family law, where the presence of artificial intelligence can manage and organize many problems in decision-making well. family law, which includes topics such as marriage, divorce and annulment, financial issues arising from it, fostering and maintenance of children, is one of the topics that the long decision-making process and referral to the courts, emotional and psychological damages increases and creates an erosion process for the parties. the help and presence of artificial intelligence, in addition to being more accurate in recognizing the personality and areas of commonality or difference between people for life or separation, can also be effective in the decision process to bring more accuracy and speed for such cases  and less harm is caused to people and their mental health, and the possibility of mistakes in decisions is reduced. various countries have also paid attention to these applications, which are mentioned in this article as the objective applications of artificial intelligence in solving family law issues, and the capabilities and rules of its use in iran’s legal system are examined
