مبانی و ابعاد حق بر حریم خصوصی در روابط خانوادگی

حریم خصوصی در میان زوجین یکی از حقوقی است که عده‌ای آن را انکار می‌کنند و عده‌ای خود را مدافع سرسخت آن اعلام می‌کنند. بااین‌حال، در اسناد حقوق بشر حتی زن و شوهر هم در روابط خود از حق حریم خصوصی که لازمه حفظ کرامت انسانی آنهاست بهره‌مند هستند، اما کیفیت و کمیت این حق در درون خانواده متفاوت از دیگر نهادها می‌باشد. دولت‌ها نیز در جهت اهداف سیاسی خود گاه حریم خصوصی زندگی شهروندان خود را مورد تعرض قرار می‌دهند. سیاست هایی نظیر افزایش یا کاهش جمعیت، می تواند حق حریم خصوصی شهروندان را در معرض خطر قرار دهد و در نظام حقوقی بیشتر کشورهای جهان، قانون‌گذاری در زمینه حمایت از حق حریم خصوصی در خانواده با کم‌توجهی روبه‌رو بوده است. بعضی کشورها تنها نقض این حق را مورد جرم انگاری قرار داده‌اند و در جهت حمایت موثر از آن گام دیگری برنداشته اند. امروز که گسترش فناوری و ابزارهای ارتباطی دایره حق حریم خصوصی را بسیار تنگ کرده است، دخالت مثبت دولت‌ها در جهت قانون‌گذاری و اقدام‌های اجرایی برای تضمین حقوق شهروندان در خانواده، از اهمیت بسیار والایی برخوردار می‌باشد.

privacy between couples is one of the rights that some deny it and others protect and advocate. however in human rights instruments, man and woman even in their relations together enjoy the right of privacy that is necessary for their human dignity, but the domain and quality of this right inside the family is different from other social institutions. governments sometimes breach the privacy of citizens in accordance of their political goals. some policies such as increasing or decreacing population may be put the privacy right at the risk of breach and in most countries legal systems, lawmaking for protection of privacy in family life is neglected. some states only criminalize breach of the right and do no more effective actions. nowadays development of technologies and communicational tools, delimits domain of application of the right and active interference of states to lawmaking and executive actions to ensure human rights in family is more important.
