قواعد فقهی مرتبط با ایجاد مسئولیت در فضای مجازی با تاکید بر قاعده ارشاد جاهل

 قواعد فقهی در مقابل قاعده اصولی، قواعدی هستند که در تمام ابواب فقه جریان دارند و در استنباط احکام جزئی به کار می روند. در این میان برخی از قواعد فقهی تبیین کننده مسئولیت افراد جامعه اسلامی نسبت به هم هستند. سوال اصلی پژوهش این است که این قواعد کدامند و طبق چه ادله ای می توان این قواعد را استنباط کرد؟ روش تحقیق پژوهش توصیفی_تحلیلی می باشد. جامع اطلاعات تمام آیات روایات و اقوال فقها است .قاعده ارشاد جاهل طبق برخی از آیات و روایات  قاعده فقهی مسئولیت ساز می باشد. یکی از کاربردهای مهم این قاعده در فضای مجازی است. طبق این قاعده، عالمان و آگاهان نسبت به کاربران این فضا متعهد و مسئول هستند و هرگونه غفلت از این مسئولیت با توجه به ویژگی‌های خاص فضای مجازی از یک سو و نبود اطلاعات کافی و لازم در کاربران آن از سوی دیگر موجب خسران برای عالمان و هم برای جامعه خواهد شد. 

jurisprudential rules related to responsibility development in virtual space with emphasis on the rule of ignorant guidance

the rules of jurisprudence, in contrast to the rules of principle, are the rules that flow in all chapters of jurisprudence and used in divining minor rulings. meanwhile, some jurisprudence rules explain the islamic society people’s responsibility towards each other. the main question of this study refers to what these rules are and based on which proof these rules can be deduced? the research method of the current study is descriptive analytical research.  the comprehensive data comes from quran verses, hadiths and the jurists’ quotes. according to some verses and hadiths, the rule of ignorant guidance is a jurisprudential rule that creates responsibility. one of the important applications of this rule is in virtual space which makes the scholars committed and responsible towards the users of this space. any neglect of this responsibility due to the special features of virtual space on one hand and the lack of sufficient and necessary information among its users on the other hand will cause losses for both scholars and society.
