دولت هوشمند و حقوق بشر؛ تصویری از آینده

«دولت هوشمند»، دولتی است که کارگزاران آن هوش مصنوعی خواهند بود و نه انسان ها. روندهای فناوری نشان می دهد چنین دولت هایی در آینده بسی فراتر از دولت الکترونیک و دولت مجازی، براساس اعتماد انسان به تصمیم گیری بهینه ی هوش مصنوعی و با تبدیل قانون اساسی به الگوریتم اساسی شکل خواهند گرفت. پژوهش حاضر با روش توصیفی – تحلیلی در پی پاسخ به این پرسش است که با تحقق دولت هوشمند، حقوق بشر چه وضعیتی خواهد داشت. از آنجا که آنچه اعتماد بیشتر به هوش مصنوعی را رقم می زند، گستره اطلاعاتی است که توسط کاربران و شهروندان در اختیار او قرار می گیرد، انتظار می رود هوش مصنوعی، مفهوم حریم خصوصی و بسیاری از مشاغل را دگرگون کند و تغییرات بنیادی در نهادهای اجتماعی نظیر خانواده پدید آورد. اقتضای این روند آن است که مردمسالاری و حقوق سیاسی ناشی از آن، مفهوم تازه ای بیابند، نظارت بر دولت دچار تحول شود، شهروندی به هوش مصنوعی توسعه یابد، حکومت قانون در معنای کمّی خود تقویت و انعطاف پذیری قاعده حقوقی تضعیف شود و حقوق بشر، جایگاه خود را در روابط بین المللی از دست بدهد. در واقع دولت هوشمند، خطری است برای ذات کرامت انسانی و آنچه این خطر را دفع خواهد کرد؛ اجماعی گسترده بر سر اخلاق و ارزش های الگوریتم اساسی است

intelligent state and human rights, a future perspective

intelligent state is the state which is the artificial intelligence (ai) its agent and not human beings. the technological process is shown that such states will be established beyond electronic state and cyber state on the basis of human reliance on optimized decision making by ai and transformation of the constitution to the constitutional algorithms. the present descriptive-analytical paper seeks to answer the question of that what would be the position of human rights at the possible future fulfillment of the intelligent state. this shows that wide information which is given by users and citizens to them, leads to more confidence in ai. so, it is expected that ai will revolve the concept of privacy and many jobs and make fundamental changes in social institutions such as the family. this process requires that democracy and political rights which is aroused to find new concepts to evolve supervision on the state, to develop citizenship to ai and causes losing human rights’ position in international relations. in fact intelligent state is a danger to human dignity itself and what it will dispose this danger is global consensus on constitutional algorithms ethics and values.
