بررسی جرائم ناقص(شروع به جرم،جرم عقیم،جرم محال)

یک جرم از زمانی که مجرم قصد ارتکاب آن را می کند تا زمانی که در عالم خارج وارد می شود، مراحل مختلفی را پشت سر میگذارد. مراحلی چون ایجاد اندیشه مجرمانه، طراحی و برنامه ریزی، تهیه مقدمات و تدارکات، شروع به ارتکاب و حصول نتیجه که درصورت اخیر است که می گوییم جرم واقع شده و مجرم مستحق مجازات است. ماده 122 قانون مجازات اسلامی مصوب 1392 مقررمی دارد که هرکس قصد ارتکاب جرمی کند و شروع به اجرای آن کند ولی به واسطه عامل خارج از اراده او قصدش معلق بماند،مجازات می شود. امکان یا عدم امکان وقوع جرم در زمان ورود به عملیات اجرایی جرم است. اگر در زمان شروع به اجرای جرم وقوعجرم غیرممکن شود یا جرم محال یا مباح است و مستحق واکنش نیست به عبارتی فاقد وصف جزایی اند. اگر در عملیات اجراییوجود مانع یا فقدان موضوع جرم باشد جرم محال است. اگر در شروع به اجرای جرم وقوع جرم ممکن باشد یا شروع جرم محقق میگردد و یا جرم عقیم اتفاق می افتد و این موارد مذکور در زیر مجموعه جرایم ناقص و ناتمام تحلیل می شود.
