بررسی ولایت قهری پدر و جد پدری در حقوق ایران

لفظ ولایت دارای مفاهیم وسیع و گسترده‌ای است که در مفهوم عام یعنی کسی که سلطه‌ای بر مال و جان دیگری پیدا می‌کند و در مفهوم حقوقی یعنی سلطه‌ای که قانون به طریقی به شخصی داده که امور مربوط به دیگری را انجام دهد و کسی که این اقتدار را دارد ولی نامیده می‌شود که به دو قسم ولی عام و ولی خاص تقسیم می‌شود. ولی عام کسی است که امور مربوط به اشخاص را در حدود قانون بر عهده دارد و این شخص از سوی مرجع صلاحیت دار این صلاحیت و شایستگی را دارد لذا حاکم ولی عام است و اکنون سمت حاکم را دادستان برعهده دارد و قانون وظایفی را برعهده وی نهاده است. ولی خاص عبارت است از ولایت پدر و جد صغیر و وصی منصوب از طرف آنان که ماده 1194 قانون مدنی نیز به آن اشاره و عنوان کرده که پدر و جد پدری و وصی از طرف یکی از آنان ولی خاص طفل نامیده می‌شود. هدف از این پژوهش بررسی ولایت قهری پدر و جد پدری در حقوق ایران می باشد. روش انجام تحقیق توصیفی- تحلیلی است. برای گردآوری اطلاعات از روش مطالعات کتابخانه ای کمک گرفته شده است که با ابزار فیش برداری ، داده ها جمع آوری گردیده اند. نتایج تحقیق نشان داد که ولایت بر طفل برعهده پدر و جد پدری است (به صورت مشترک) و مادر حق هیچگونه دخالتی در این خصوص نداشته و نسبت به اداره اموال فرزند خویش سمتی ندارد.

the word wilayat has wide and broad meanings, which in the general sense means the person who has authority over the property and life of another, and in the legal sense, it means the authority given by the law to a person to do the affairs of another and the one who exercises this authority. it is called a guardian, which is divided into two types: general guardian and special guardian. a public guardian is someone who is in charge of matters related to individuals within the limits of the law, and this person has this authority and competence from a competent authority, so he is a sovereign guardian, and now the prosecutor holds the position of sovereign, and the law has assigned duties to him. is. a special guardian is the guardianship of a minor s father and grandfather and a guardian appointed by them, which article 1194 of the civil code also mentions and states that a paternal grandfather and a guardian on behalf of one of them is called a special guardian of a child. the purpose of this research is to investigate the coercive guardianship of father and paternal ancestor in iranian law. the research method is descriptive-analytical. in order to collect information, the library studies method has been used, and the data has been collected with a chip collection tool. the results of the research showed that guardianship over the child is the responsibility of the father and paternal grandfather (jointly) and the mother has no right to interfere in this matter and has no role in managing her child s property.
