راهبرد جامع روش مطالعات و تحقیقات در علم حقوق با رویکرد اسلامی کردن علوم انسانی

مقوله اسلامی کردن علوم انسانی که از مهمترین نیازهای جامعه و فرهنگ اسلامی ما بشمار می رود، تاکنون از زوایای مختلفی مورد بررسی قرار گرفته است. به نظر می رسد بین زوایا و ابعاد مزبور، وحدت حقیقی و تغایر اعتباری وجود دارد زیرا مقوله مزبور امری واحد بوده که از دریچه های مختلف بدان نگریسته می شود. به همین دلیل، به نظر نگارنده به جای نگریستن از جهات مختلف به موضوع، بهتر است ذات ، حقیقت و نظام این امرِ مهم مورد کاوش واقع شود. از این منظر، اسلامی کردن علوم امر نظام مندی است که از سیستمی جامع و هماهنگ برخوردار بوده و جزئی نگری آفت مهم آن محسوب می شود. بدین ترتیب راهبرد جامع علوم انسانی اسلامی از برآیندِ سه ضلعیِ زوج های محقّق- محیط، محقّق- منبع و محقّق- روش حاصل می شود. به عبارتی بهتر برای رسیدن به هدف مزبور، باید در یک نظام هماهنگ و جامع که اجزای آن به شدت با یکدیگر مرتبطند، نخست مقدمات اسلامی کردن علوم را فراهم آوریم. اسلامی کردن اندیشه محقق، محیط تحقیق ، منابع تحقیق و سرانجام اسلامی کردن روش تحقیق منجر به تولید علم اسلامی خواهد شد. مقاله حاضردر تلاش اثبات و شرح مقدمات پیش گفته است.

comprehensive strategy of studies and research methods in law science with the approach of islamizing humanities

the category of islamization of humanities, which is considered one of the most important needs of our society and islamic culture, has been investigated from different angles. it seems that there is a real unity and difference of credit between the angles and dimensions mentioned because the category is a single thing that is looked at from different perspectives. for this reason, in the author s opinion, instead of looking at the subject from different angles, it is better to explore the essence, truth and order of this important matter. from this point of view, islamization of sciences is a systematic matter that has a comprehensive and coordinated system. and partiality is considered its most important pest. in this way, the comprehensive strategy of islamic humanities is obtained from the triangular outcome of researcher-environment, researcher-source and researcher-method couples. in a better word, in order to achieve the aforementioned goal, we must first prepare the foundations for the islamization of sciences in a coordinated and comprehensive system whose components are strongly related to each other. islamizing the researcher s thought, research environment, research resources and finally islamicizing the research method will lead to the production of islamic science. the present article tries to prove and explain the aforementioned premises.
