یکی از اصول جبران خسارت این است که تمام خسارات که در نتیجه اجرا نشدن تعهد به شخص دیگری وارد می شود، باید به هر نحوی جبران شود. راه‌هایی که برای جبران خسارت می‎توان برشمرد یکی آن است که وضع زیان‌دیده به حالت قبل از ورود ضرر برگردانده شود راه حل دیگر نیز جبران خسارت از طریق دادن معادل آن است. در خصوص اینکه خسارت ناشی از نقض تعهد در چه زمان محاسبه می‌شود و زمانی به شکل در تغییر خسارت ناشی از نقض تعهد نقش ایفا می‌کند در مقررات ایران چیز مشخص یافت نمی شود. بهترین زمان ارزیابی خسارات ثابت، زمانی است که سبب ضمان آور رخ می دهد زیرا ضرر واقعی وارده به مالک تنها در این زمان قابل تشخیص است. اما این امر بدان معنی نیست که میزان وجه نقدی که به زیان دیده باید پرداخته گردد از نظر عددی باید مساوی با قیمت کالا در روز وقوع فعل زیان بار باشد بلکه با توجه به اینکه ادای دین یک امر عرفی است تاثیرات کاهش یا افزایش ارزش پول در میزان جبران باید مورد ملاحظه قرار گیرد.
