بررسی حقوقی ارتباط بنگاه های اقتصادی و نظام بانکی و نقش آن بر اقتصاد

در این پژوهش، تلاش شده است تا تفاوت بین بازار پولی و سرمایه‌ای مورد بررسی قرار گیرد و اهمیت بازار سرمایه‌ای در کشورهای در حال توسعه به همراه نقش سرمایه‌گذاری در بخش خصوصی، شرکت‌های سهامی، شرکت‌های دانش بنیان و اندیشه‌های نو بررسی شود. این مطالعه به این دلیل است که سیستم تامین مالی بانکداری اسلامی، در مقابل سیستم‌های بانکداری آنگلاساکسون و آلمانی، نقش مهمی در این زمینه ایفا می‌کند. بازار سرمایه‌ای در نظام اقتصادی، به رشد اقتصاد سرمایه‌ای و کاهش وابستگی به فروش نفت در کشور کمک می‌کند. یکی از نکات حائز اهمیت در این پژوهش، ارائه راهکارهای مشاوره‌ای و استفاده از تخصص کسب و کارها توسط بانک‌ها در زمینه توجیه اقتصادی و ارائه راهکارهای تامین مالی، مدیریت ریسک، مدیریت پروژه و اعتبارسنجی است. همچنین، شرکت‌ها و بنگاه‌های اقتصادی قبل از ورود به عرصه‌ی اقتصادی و پس از تایید فرایندهای لازم، می‌توانند تسهیلات بانکی دریافت کنند یا پروژه‌های خود را آغاز کنند تا بهبود و توسعه شرکت‌ها را به همراه داشته باشند و در عین حال از متضرر شدن احتمالی جلوگیری شود. به علاوه، این تدابیر می‌تواند بانک‌های کشور را ترغیب به تغییر رویکرد خود برای تبدیل به نظام بانکداری اسلامی کند تا از مداخله مستقیم در نظام اقتصادی جلوگیری شود.

in this research, an attempt has been made to investigate the difference between monetary and capital market and to examine the importance of capital market in developing countries along with the role of investment in the private sector, joint-stock companies, knowledge-based companies and new ideas. this study is because the financing system of islamic banking, in contrast to the anglo-saxon and german banking systems, plays an important role in this field. the capital market in the economic system helps to grow the capital economy and reduce dependence on oil sales in the country. one of the important points in this research is the provision of consulting solutions and the use of business expertise by banks in the field of economic justification and the provision of financing solutions, risk management, project management and validation. also, companies and economic enterprises before entering the economic arena and after confirming the necessary processes, can receive bank facilities or start their projects to improve and develop the companies and at the same time avoid possible losses. . in addition, these measures can encourage the country s banks to change their approach to convert to the islamic banking system in order to avoid direct intervention in the economic system.
