طراحی مدل مفهومی فرایند تنظیم‌گری فناوری دارایی‌های دیجیتال رمزنگاری شده و زنجیره‌بلوکی با تکیه بر تجربیات جهانی

طی سال‌های اخیر دارایی‌های رمزنگاری شده مبتنی بر فناوری‌ زنجیره بلوکی یکی از مهم‌ترین عوامل ایجاد تحولات در حوزه‌های مختلف اقتصاد دیجیتال و به بیانی دیگر یکی از پیشگامان تحول دیجیتال در دوران انقلاب چهارم صنعتی بوده است. ‌‌دارایی‌های دیجیتال رمزنگاری شده، در ماهیت خود فرصت‌ها و تهدید‌هایی را به همراه دارند که در صورت عدم جهت دهی صحیح به روند حرکت هرکدام از مصادیق آن، به تنهایی می‌توانند در اقتصاد کشورها و اقتصاد جهانی تاثیر‌گذار باشند. در این راستا بسیاری از جوامع، مطالعات و روشهای گسترده ای را برای بکارگیری از این ظرفیت ایجاد شده انجام داده اند و به دنبال یافتن دستورالعمل های کاربردی و بکارگیری الگویی متناسب با نظام اقتصادیشان هستند. در این مقاله سعی شده است با استفاده از روش مرور سیستماتیک و مطالعات کتابخانه‌ای، رویکردهای ‌‌تنظیم‌گری در سراسر جهان مورد تجربه‌نگاری قرار گیرد و در ادامه با استفاده از نظرات خبرگان و نخبگان این حوزه، عوامل اثرگذار بر ‌‌تنظیم‌گری این حوزه در کشور احصاء و مدل مفهومی فرایند تنظیم‌گری به طوری که منطبق بر ساختار نظام اقتصادی، حقوقی و فقهی کشور باشد، ترسیم گردد. با توجه به نتایج پژوهش، از با اهمیت ترین عواملی که جهت ‌‌تنظیم‌گری ‌‌دارایی‌های رمزنگاری شده در ایران ‌‌می‌بایست مورد نظر قرار بگیرند عبارتند از: قوانین تابع موازین اسلامی، شناسایی ماهیت و نحوه استفاده از ‌‌دارایی‌های رمزنگاری شده، آماده‌سازی بسترهای حقوقی و اقتصادی کشور، تفکیک موضوعات مختلف این حوزه و ‌‌تنظیم‌گری هرکدام به صورت مجزا می باشد. به طور کلی نیز چهار مولفه به شرح ماهیت فناورانه، شرایط و اقتضائات داخلی کشور، رخدادهای جهانی و دلایل اقبال مشخص شدند که با توجه به ارزیابی هرکدام ‌‌الگوی راهبردی ‌‌تنظیم‌گری ‌‌دارایی‌های رمزنگاری شده با نگاه بر گستره کشوری ارائه گردید.

designing a conceptual model for the regulation process of crypto assets based on global experiences

in recent years, crypto assets based on the blockchain technology, have emerged as a transformative force across various sectors of the digital economy. the emergence of these assets presents both opportunities and risks, each with the potential to impact national and global economies. in response, many countries are seeking regulatory frameworks tailored specifically to their own economic systems, in order to effectively manage the complexities of the crypto landscape. the modus operandi of this study unfolded in three stages. first, it aimed to empirically investigate the emerging global trends in the regulation of crypto assets by conducting a systematic review and employing library-based research methods. second, the study sought to identify the key factors influencing the regulation of crypto assets in iran through expert interviews.finally, based on these findings, the article aimed to propose a strategic regulatory model that aligns with the country’s economic, legal, and jurisprudential frameworks. the findings highlight several critical factors that must be considered when regulating crypto assets in iran. these include ensuring of compliance with islamic principles, clearly defining the nature and the course of use of crypto assets, preparing the legal and economic infrastructures of the country, and addressing the diverse aspects of crypto assets separately in regulatory approaches. furthermore, the study identifies four core components that should inform the regulatory strategy: the nature of the technology behind crypto assets, the specific conditions and exigencies relating to iran’, global trends, and the motivations behind the use of crypto assets. finally, based on the evaluation of each, a strategic model for regulating crypto assets was presented with a country-wide perspective.
