کارکرد قاعده لا‌ضرر در احکام رفتار با حیوانات

با وجود مصادیق پرتکرار و پر اهمیت قاعده لاضرر در برخورد انسان امروزین با جانوران، این قاعده در پژوهش های فقهی پیرامون رفتار با حیوانات به ندرت موردتوجه قرار گرفته است. پژوهش های اسلامی پیرامون نحوه تعامل با حیوانات هم برای جعل قوا نین مرتبط بسترسازی خواهند کرد و هم در مرحله اجرای این قوانین ، برای قشر متدین جامعه ضمانت اجرای شرعی به همراه خواهند داشت. هدف از این پژوهش که با روش تو صیفی تحلیلی نگاشته شده است، بیان مصادیق لاضرر و تحلیل کیفیت تطبیق این قاعده دراحکام مواجهه با حیوانات بوده است؛ به این منظور در گام اول مهمترین اختلاف نظرهای اصولی پیرامون قاعده لاضرر و تاثیر آنها بر اصل و نحوه مصداق گزینی قاعده بیان شده اند؛ در گام دوم پس از بیان نکاتی که لازم است در تطبیق لاضرر بر مصادیق زیست محیطی مورد توجه قرار گیرند ، مهمترین مصادیق این قاعده در مواجهه با حیوانات مورد بررسی قرار گرفته اند .

the function of the rule of la-ḍarar in islamic rulings on animal treatment

despite the frequent and significant instances of the application of the la-ḍarar (no-harm) rule in contemporary human treatment with animals, this rule has rarely been the focus of fiqhi research. research in islamic jurisprudence on the proper way of treating animals will not only pave the way for enacting relevant laws, but will also provide religious enforcement mechanisms for the believing segment of society in the implementation of these laws. the objective of this descriptive-analytical research is to pinpoint the instances of la-ḍarar and analyze the manner of applying this rule in rulings regarding the treatment of animals. to this end, in the first step, the most significant disagreements regarding the la-ḍarar rule and their impact on the manner of identifying its instances are delineated. in the second step, recognizing the considerations that need to be taken into account in applying the rule of la-ḍarar to environmental instances, the most important instances of this rule in treating animals are examined.
