بازپژوهی ممیزات ترور و محاربه در فقه امامیه

در حوزه فقه اجتماعی، مباحث امنیت و آسایش عمومی و بالخصوص سلب امنیت اجتماعی و اقداماتی چون محاربه که به رفتارهای خوف‌انگیز همراه با به رخ کشاندن و استفاده از سلاح اعم از سردوگرم، از جمله مسائل و مباحث جدی قابل‌توجه هست که در فقه جزایی برای آن شدیدترین برخوردها و مجازات پیش‌بینی و در نظر گرفته شده، همان‌گونه که به‌صراحت قرآن کریم به آن پرداخته است. در کنار آن بحث ترور و قتل‌های اغتیالی به جهت تناسب و هم‌سنخ بودن با مباحث محاربه موردتوجه فقه جزایی به لحاظ مفهومی و حکمی هست و لازم است در نگاه جامع به فقه اجتماعی و حکومتی چنین مباحثی به طور مرتب بازپژوهی و به‌حکم استحداثی مورد تدقیق قرار گیرد. در مقاله پیش‌رو و به مباحث مرتبط با محاربه و ترور با نگاهی به ممیزات آنها به روش توصیفی تحلیلی و با ابزار کتابخانه‌ای پرداخته شده است.

reexamining the characteristics of assassination and muhāribah in imamiyyah jurisprudence

in the realm of social fiqh, discussions regarding public order and security, and particularly the deprivation of social security and actions such as muhāribah, which involve intimidating behaviors accompanied by the display and use of weaponry, are among the serious issues that have been met with the most arduous punishments in criminal jurisprudence, as explicitly addressed in the holy quran. alongside this, the issue of assassination and targeted killings is also considered in criminal jurisprudence due to its conceptual and legal affinity with the discussions of muhāribah. it is necessary that such issues be regularly reexamined and scrutinized in a comprehensive view of social and state fiqh. the present article addresses the topics related to assassination and muhāribah, examining their characteristics through a descriptive-analytical method utilizing library resources.
