بررسی تطبیقی کاربست اصل استصحاب در موضوعات مستحدثه در فقه مذاهب اسلامی و تطور تار یخی آن

استصحاب یکی از مسائل پرکاربردِ اصول‌فقه است و فقیه، در استنباط حکم مسائل مستحدثه، پس از یاس از یافتن حکم شرعی در ادله‌‌ی اربعه، آن را مستند حکمِ شرعی خود قرار‌می‌دهد. بررسیِ تاریخیِ نحوه‌ی شکل‌گیری «استصحاب» بین مذاهب اسلامی براساس منابع دست اولِ اصولیان شیعه و سنی، نشانگر میزان مشارکت و اثرگذاری ایشان در شکل‌گیری و تطور این اصل، به عنوان بخش مهمی از علم اصول‌فقه است. رهاورد این پژوهش که با روش گردآوری داده‌های کتابخانه‌ای ساماندهی شده‌است، این است که اولین کاربست اصل استصحاب در موضوعات مستحدثه در جوامع علمی اهل‌سنت شکل گرفته‌است؛ اما علی‌رغم ورود زود هنگام، در ادامه مسیرِ علمیِ خود، دچار رکود شدند. درمقابل، نمودار مواجهه اصولیان شیعی با کاربست استصحاب، یک نمودار صعودی است که در آغاز به اتخاذِ اصل استصحاب از اهل‌سنت می‌پردازد، در میانه راه آن را بر‌اساس اصول مذهب خود اصلاح نموده و در ادامه، تعاریف و عملکردهای فقهیِ پرکاربردی برای آن وضع می‌کند و این حرکت تاکنون استمرار دارد.

a historical study of the application and development of the principle of istiṣhāb in islamic jurisprudence

istiṣhāb (presumption of continuance), a concept frequently addressed in the principles of islamic jurisprudence (uṣūl al-fiqh), involves a jurist resorting to it as a legal basis for their ruling when unable to find a specific sharīah ruling in the four recognized sources. the current historical investigation examines the origins of istiṣhāb within islamic traditions, drawing from primary sources of both shia and sunni scholars, highlighting their contributions and influence in shaping and advancing this principle as a significant component of the science of jurisprudential principles. through a library research methodology, the study concludes that the initial application of the principle of istiṣhāb emerged within sunni scholarly circles. however, despite its early introduction, it experienced a stagnation in its scholarly progression. conversely, the trajectory of shia scholars’ engagement with istiṣhāb follows an upward trend. initially adopting the principle from sunnis, they then modified it based on their own religious principles, establishing comprehensive definitions and widely accepted jurisprudential practices. this movement persists to the present day.
