معاونت زنان خیابانی در جرایم جنسی و نسبت آن با قوادی، با محوریت قانون مجازات اسلامی مصوب 1392

جرم قوادی از جمله جرایمی است که علاوه بر ارتباط مستقیم با هتک عفت عمومی و از بین بردن اخلاق انسانی، زمینه ایجاد جرایم متعددی را فراهم می‌کند. بنابراین، شناخت زمینه‌های به وجود آمدن آن و فراهم نمودن مقدمات و از بین بردن این جرم حائز اهمیت فراوان است. از جمله زمینه‌های مهم و اساسی جرم قوادی، وجود زنان خیابانی می‌باشد که در این میان، شناخت پدیده زنان خیابانی و ارتباط آن با جرم قوادی که خود می‌تواند زمینه‌ساز جرایم متعددی به نحو تصاعدی باشد از اهمیت فوق‌العاده‌ای برخوردار است. از این رو، در پژوهش حاضر به بررسی وجود زنان خیابانی و فعالیت‌های آنها به عنوان زمینه‌ساز تحقق جرم قوادی و ناهنجاری‌های اجتماعی مرتبط با آن پرداخته شده است؛ چراکه شناخت چگونگی فعالیت‌های زنان خیابانی، پاسخ بدین پرسش خواهد بود که آیا رفتار آنها مشمول جرم قوادی می‌باشد یا خیر؟ همچنین، این که اساساً قوادی جرمی جدا از سایر جرایم جنسی مرتبط می‌باشد یا خیر، نیاز به کاوش و بررسی پژوهشی دارد و باید ابهامات آن را برطرف نمود.

offence of pandering is one of the offences that has direct connection to destruction of public morals and it also causes commission of several offences. accoringly, recognizing the grounds of its commission and preparing for its removing is of high significant. one of the main and basic grounds of this offence is street girls. in this regard it is of high importance to study the phenomenon of street women and their relationship to offence of pandering. this offence may facilitate the commission of several crimes. this article deals with the street women and their activities as fasiciltator for commission of the offence of pandering and its related social abnormalities. the exploring of these activities will be answering to this question whether their activities may be regarded as the offence of pandering. it also is necessary to study whether basically this offence itself is a seperat offence from the other ones. the study must clarify the ambiguities.
