پژوهشی بر کلیت نظام سردفتری ایران

اهمیت دفاتر اسناد رسمی با عنایت به ضرورت توسعه حقوق شهروندی و تبدیل فرهنگ خشونت و نزاع به فرهنگ صلح، دوستی و دموکراسی، بر کسی پوشیده نیست. از این روی، سردفتری اسناد رسمی به‌عنوان یک نهاد حقوقی- مدنی و متکفل خدمات عمومی بایستی متضمن پویایی و پاسخگویی لازم باشد. سئوال و هدفی که در این مقاله مطرح می‌شود این است که آیا نظام سردفتری اسناد رسمی در ایران، متضمن این پویایی و پاسخگویی هست؟ پژوهش حاضر با روش تحلیلی و کتابخانه‌ای مبتنی بر این فرضیه است که ابهام در ماهیت نظام سردفتری ایران و اداره آن با اعمال سلیقه و نظام بخشنامه‌ای، ظهور فناوری جدید و پیدایش نهادهای نوبنیاد، عامل ناکارآمدی برخی مقررات در این نهاد به‌شمار رفته و مانع شفافیت و پویایی لازم گردیده و این نتیجه را به‌دست می‌دهد که سردفتری در ایران بایستی به‌سوی یک نظام حرفه‌ای خصوصی با ماهیت عمومی، غیرحاکمیتی و بی‌طرف هدایت شود.

a study on the system of iran’s notary offices

the importance of the notary public is no secret given the necessity of developing citizenship rights and transforming the culture of violence and strife into a culture of peace, friendship and democracy. therefore, the notary public as a legal-civil and public-service body should ensure dynamism and accountability.  the question and purpose of this article is whether the official system of official documents in iran, is dynamic and accountable? the present research is based on the analytical and library method under the assumption that the ambiguity in the nature of the iranian notary system and its administration by personal interests and circular system, the emergence of new technology and also new foundations are the underlying reasons for inefficiencies of some regulations in this institution which in turn impedes the required dynamism and transparency.  this study yields the conclusion that the notary offices in iran must be guided by a private, non-sovereign, impartial public professional system.
