مولفه‌ها و شرایط انتصاب قاضی تراز در اندیشه های مقام معظم رهبری

نیروی انسانی به مثابه مهمترین عامل در سنجش عملکرد دستگاه قضایی و در راس آن، قاضی به‌عنوان فیصله دهنده‌‌ی دعوا و صادرکننده حکم از اهمیت و جایگاه بسیار والایی برخوردار است. منصب قضاوت در همه نظام‌های حقوقی به‌عنوان جایگاهی خطیر و والا شناخته شده است و قانون اساسی جمهوری اسلامی ایران نیز منبعث از فقه امامیه و مبانی اسلامی، جذب قضات شایسته و عادل را مورد تاکید قرار داده است. با عنایت به اینکه ولایت بر قضاء از جمله شوون ولی فقیه در عصر غیبت است لذا مطالعه و شناخت اندیشه‌های مقام معظم رهبری در خصوص جذب قضات دارای اهمیت است که در این پژوهش با استفاده از رویش توصیفی تحلیلی شرایط و مولفه‌های بکارگیری قضات از دیدگاه مقام معظم رهبری مورد مداقه و بررسی قرار گرفته است. از نگاه مقام معظم رهبری نقش قضات در دستگاه قضایی محوری است و توجه به شایستگی‌های فقهی، اخلاقی و علمی قضات واجد اهمیت است. با توجه به اهمیت منصب قضاء در فقه اسلامی شرایط فقهی و اخلاقی قضات مانند عدالت، صبر و شکیبایی، تواضع و مردمداری همواره مورد تاکید مقام معظم رهبری قرار داشته و سپردن قضاء در عصر غیبت به قضات ماذون و نادیده گرفتن شرط اجتهاد به معنای انتفای سایر شروط و ضوابط فقهی انتصاب قضات نبوده و از نظر ایشان عدالت و تقوا از شروط اساسی متصدیان منصب قضاء به شمار می‌رود.
