تعریف حقوق مالکیت فکری برای بیان تعارض منافع عمومی و خصوصی موضوعی مهم و بنیادین است؛ زیرا مشخص بودن اهداف، اصول و اثبات مال بودن محصول فکری و مالکیت پدیدآورنده مباحثی است که ارزش منافع عمومی و خصوصی را در حقوق مالکیت فکری مشخص می سازد؛ از سوی دیگر زمینه مناسبی برای بیان تعارض منافع عمومی و خصوصی ایجاد می کند. پرسش مهمی که قبل از بررسی سوابق و زمان شکل‌گیری حقوق مالکیت فکری پیش می آید، طرح سوال پیرامون حقوق مالکیت فکری و شناسایی گستره ای است که می بایست تعارض در میان منافع عمومی و خصوصی در آن بررسی گردد، زیرا بدون مشخص شدن معنا و مفهوم یک موضوع و گستره کاربردی و عملی آن، بررسی و ارائه راه‌حل کار در خصوص آن غیرممکن و در صورت انجام بیهوده است. این پژوهش در پی آن است تا با روش توصیفی و تحلیلی اثبات نماید که اولویت بخشیدن نسبت به هریک از این دو منفعت می‌تواند نحوه حمایت از آثار مالکیت فکری و مدت این حمایت را مشخص نماید؛ به عبارتی چنانچه در یک کشور منافع خصوصی افراد (پدیدآورندگان) ارجحیت داشته باشد، باعث می‌شود که مدت و نحوه حمایت از پدیدآورندگان در قانون آن کشور طولانی تر و جدی‌تر باشد و اگر به منافع عامه توجه شود، مدت حمایت کم‌تر و نحوه حمایت ضعیف‌تر می‌شود.
