رهیافت‌های رشد مدارانه با تاکید بر قانون حمایت از اطفال و نوجوانان ایران و رسیدگی به تخلفات اطفال افغانستان

در سال‌های اخیر نظریات متعددی در حوزه پیشگیری از جرم به‌منظور کاهش میزان جرائم از سوی اندیشمندان این حوزه مطرح‌شده است. ماهیت اصلی جرم‌شناسی رشد مدار مبتنی بر مطالعه جرم در بستر زندگی هر فرد است. این نوع جرم‌شناسی با رویکردی پیشگیرانه، به دنبال شناسایی عوامل موثر بر بزهکاری کودکان و نوجوانان است و با تقویت عوامل حمایت‌کننده رفتارهای اجتماعی، از ناسازگاری، انحراف و اعمال مجرمانه توسط آنان جلوگیری به عمل‌آورده است. از سوی دیگر، جرم‌شناسی رشد مدار با رویکرد پیشگیرانه همواره تلاش نموده است تا افراد را در معرض عوامل مثبت قرار داده و عوامل منفی و خطرناک را کاهش دهد. به‌طورکلی، عوامل عنوان‌شده را می‌توان هم به‌نوعی عامل خطر و هم عامل پیشگیری و زمینه رشد کودکان و نوجوان دانست. ازاین‌رو، در راستای قانون حمایت از اطفال و نوجوانان، این پژوهش تلاش نموده است تا با بهره‌گیری از روش تحلیلی _ توصیفی، علاوه بر شناخت عوامل پیشگیری رشد مدار، میزان انطباق نظام جرم شناختی حاکم بر قانون ایران و افغانستان بر رهیافت‌های رشد مدار را مشخص نماید.

developmental approaches with an emphasis on the protection of children and adolescents in iran and addressing child offenses in afghanistan

in recent years, various theories in the field of crime prevention have been proposed by scholars to reduce crime rates in societies. the fundamental nature of developmental criminology is based on studying crime within the life context of each individual. this type of criminology, with a preventive approach, identifies factors that lead a child or adolescent towards delinquency and works to prevent the realization of these components. in other words, it strengthens the supportive factors of their healthy life to prevent deviation and criminal acts by them. on the other hand, developmental criminology with a preventive approach always seeks to expose individuals to positive factors or reduce negative and dangerous factors. in general, these mentioned factors can be considered both as risk factors and as preventive and developmental aspects for children and adolescents. therefore, in child and adolescent protection laws, developmental prevention is somewhat specific to these age groups. this research, using an analytical-descriptive method, aims to not only understand developmental prevention but also answer the question of how much the criminal justice system in iran and afghanistan aligns with developmental approaches.keywords: criminology, delinquency, prevention, developmental, children and adolescents.
