تحقق عدالت ترمیمی در شورای حل اختلاف با رویکرد دادرسی منصفانه

عدالت ترمیمی به‌عنوان شیوه‌ای جدید در راستای حل منازعات، کنش و واکنش‎های ناشی از جرم و به‌تبع آن حمایت جامع و کامل از بزه دیده و حتی بزهکار، دستاوردهای منحصربه‌فرد و نوینی را در عرصه سیاست کیفری به ارمغان آورده است. در حال حاضر عدالت ترمیمی از یک تئوری آرمان‌گرایانه به‌عنوان یک‌راه حل عمل‌گرایانه در سایر حوزه‌های حقوق شناخته‌شده است. از سویی، دیگر نمی‌توان چهارچوب مبانی این نظریه را صرفاً در حقوق جزا به‌منظور آلام بزه دیده و ترمیم شخصیت بزهکار محصور داشت، بلکه امکان بسط و گسترش دامنه این فرایند نتیجه گرا در سایر حوزه‌های حقوق علی‌الخصوص حقوق مدنی وجود دارد. در نظام حقوقی ایران، نزدیک به دو دهه است که نهادی تحت عنوان شورای حل اختلاف تاسیس گردیده است و سعی بر آن دارد تا با بهره‌گیری از اندیشه‌های سنتی، سازش و داوری را اجرایی نموده و مبانی نوین عدالت ترمیمی و اختلافات و دعاوی کم‌اهمیت افراد جامعه را از طریق دادرسی منصفانه، حل‌وفصل نماید.

restorative justice as a new way to solve conflicts, actions and reactions caused by crime and as a result comprehensive and complete support for the victim and even the criminal, has brought unique and new achievements in the field of criminal policy. currently, restorative justice is recognized as an idealistic theory as a pragmatic solution in other fields of law. on the other hand, it is no longer possible to confine the framework of this theory to criminal law in order to deal with the sufferings of the victim and to restore the character of the criminal, but it is possible to expand the scope of this result-oriented process in other areas of law, especially civil law. in iran’s legal system, it has been nearly two decades that an institution called the dispute resolution council has been established, and it tries to implement compromise and arbitration by using traditional ideas and the new foundations of restorative justice and minor disputes and claims of the society. resolve through a fair trial.
