اینترنت اشیاء به عنوان الگوی تکنولوژیکی جدید با پیامدهای عظیم اقتصادی و اجتماعی در حال پیشرفت است. اتصال به شبکه، زیربنای عملکردی را فراهم می‌آورد. با این وجود، چالش‌های فعلی و پیشین پیرامون صدور مجوز و اجرای حق اختراعات اساسی در چارچوبی استاندارد (sep)، در بخش فناوری اطلاعات و ارتباطات (ict)، در راستای توسعه فناوری اینترنت اشیا سایه گسترده است. با تمرکز بر رویکرد نظام حقوقی اتحادیه اروپا بر مبنای حقوق رقابت، این مقاله با بررسی جنبه‌های حقوقی موجود که عمدتاً در پس زمینه مشکلات صنعت موبایل ساخته شده است، می‌تواند پاسخگوی مناسب به چالش‌های مطرح شده توسط ابزارهای اینترنت اشیا و فناوری دربردارنده آنها باشد. حال، این مقاله با روش توصیفی _ تحلیلی در پی بررسی تعیین سازگاری چارچوب تنظیم مقررات فعلی اختراعات با نیازها و (sep) اساسی استاندارد توسعه اینترنت اشیاء است. در نهایت این مطالعه به این نتیجه دست یافت که با به روز رسانی و تطابق مقررات فعلی با ویژگی‌های (sep) اختراعات اساسی استاندارد منحصر به فرد اینترنت اشیاء، امکان ایجاد چارچوب حقوقی منعطف و موثرتر برای حفظ حقوق اختراع در این حوزه به وجود خواهد آمد.

the communication standards among internet of things (iot) devices; to what extent is their compatibility with the current regulatory framework for standard basic patents (seps)

iot, as a new technological paradigm, is advancing with significant economic and social implications. while network connectivity brings functional infrastructure, challenges regarding licensing and enforcement of essential patents within the standard essential patents (sep) framework in the information and communication technology (ict) sector cast a wide shadow on iot technology development. focusing on the european union’s legal approach based on competition law, this article explores existing legal aspects mainly arising from the mobile industry’s challenges to address iot tools and their encompassing technologies. using a descriptive-analytical method, it seeks to answer whether the current patent regulations framework adequately aligns with the needs and standard essential patents (sep) for iot development or not. ultimately, it concludes that updating and aligning current regulations with the unique features of standard essential patents for iot will enable the creation of a more flexible and effective legal framework for patent protection in this domain.
