نقش فناوری هوش مصنوعی در کاربردهای مالی اسلامی و بررسی جنبه‌های کیفری آن

هوش مصنوعی به‌عنوان یکی از فناوری‌های پیشرفتهٔ عصر دیجیتال، نقش مهمی در بهبود کارایی و سرعت بخشیدن به فرآیندهای مالی و اقتصادی ایفا می‌کند. با افزایش استفاده از این فناوری در سیستم مالی اسلامی، بررسی جنبه‌های حقوقی و کیفری آن به‌ویژه از منظر تطابق با اصول شرعی اهمیت بیشتری یافته است. هدف از این مطالعه، بررسی کاربردهای هوش مصنوعی در نظام مالی اسلامی و تحلیل فرصت‌ها و چالش‌های کیفری و حقوقی آن است. این پژوهش نشان می‌دهد که هوش مصنوعی می‌تواند ابزاری قدرتمند برای تشخیص و پیشگیری از جرائمی مانند کلاهبرداری، پول‌شویی و تامین مالی تروریسم باشد، درحالی‌که استفاده نادرست از آن، می‌تواند منجر به چالش‌های قانونی نظیر نقض حریم خصوصی، تقلب الگوریتمی و تلاعب در بازارهای مالی شود. همچنین، به‌منظور جلوگیری از سوءاستفاده‌های احتمالی، ضرورت تنظیم‌گری دقیق و تدوین قوانینی که مسئولیت‌ها و محدودیت‌ها را در چارچوب شریعت تعیین کنند، مورد تاکید قرار گرفته است. یافته‌های این تحقیق می‌تواند به نهادهای مالی اسلامی کمک کند تا ضمن بهره‌گیری از هوش مصنوعی، از پیامدهای منفی و جرائم مالی مرتبط با آن جلوگیری کنند.

artificial intelligence, as one of the advanced technologies of the digital era, plays an important role in improving efficiency and speeding up financial and economic processes. with the increasing use of this technology in the islamic financial system, the study of its civil and criminal aspects has become more important, especially from the point of view of compliance with sharia principles. the purpose of this study is to consider the applications of artificial intelligence in the islamic financial system and to analyze its criminal and civil opportunities and challenges. this research shows that artificial intelligence can be a powerful tool for detecting and preventing crimes such as fraud, money laundering and terrorist financing, while its misuse can lead to legal challenges such as privacy violation, algorithmic fraud and financial market manipulation. also, in order to prevent possible abuses, the necessity of strict regulation and formulation of laws that determine responsibilities and limitations within the framework of sharia has been emphasized. the findings of this research can help islamic financial institutions to avoid negative consequences and related financial crimes, while using artificial intelligence.
