چکیده
|
مسئله امنیت همیشه از دغدغه های متفکران و اندیشمندان فقهی و حقوقی محسوب شده است و فقه شیعی که همواره مسیر زندگی انسان ها را بر اساس مصالح و منافع آنان پایه گذاری نموده است، نیاز به امنیت را همانند دیگر نیازهای بشری ضروری دانسته و حتی می توان گفت؛ نگاه فقه به امنیت نوعی نگاه ویژه است. یکی از حوزه های امنیت امنیت در حوزه سلامت میباشد. از این رو پرسش اصلی پژوهش حاضر عبارت است از اینکه « مبانی امنیت در حوزه سلامت از منظر فقه و حقوق موضوعه ایران چیست؟» برای پاسخ به این پرسش و البته پرسش های فرعی حول محور آن باید کتب فقهی، ادله فقهی و شرعی و مواد قانونی ایران مورد بررسی و تحلیل قرار گیرد. فرضیه پژوهش حاضر آن است که از دیدگاه فقه امامیه و حقوق ایران امنیت در حوزه سلامت مساله ای بسیار مهم و از جمله وظایف اصلی حاکمیت و دولتها حمایت و تقویت ان است. یافته های ما حاکی از آن است که حق یادشده جزء حقوق بنیادین بشری محسوب می شود، لذا دولت ها بایستی با بهره گیری از همکاری های بین المللی و مسئولیت پذیری در خصوص این حق بشری، ظرفیت های اجرایی خود را برای تامین امنیت انسانی از طریق بهره مندی افراد جوامع بشری از چنین حقی افزایش دهند.نابرابریهای شدید سلامت، میتواند موجب بروز درگیری و به همین نحو، درگیریهای نظامی و مسلحانه، سلامت و نظام سلامت را به طرق مختلف تهدید میکنند، لذا همکاری دولتهادر حل بحرانهای سلامت، موجب تامین امنیت سلامت انسان میشود.روش تحقیق حاضر توصیفی تحلیلی با استفاده از منابع کتابخانه ای است

Abstract
|
the issue of security has always been considered as one of the concerns of jurisprudence and legal thinkers, and shia jurisprudence, which has always based the path of human life on the basis of their interests and interests, considers the need for security as essential as other human needs. it is known and can even be said; jurisprudence's view of security is a special kind of view. one of the fields of security is security in the field of health. therefore, the main question of the current research is what are the basics of security in the field of health from the perspective of iran's jurisprudence and substantive law? in order to answer this question and of course the sub-questions around it, jurisprudence books, jurisprudence and sharia proofs and legal materials of iran should be analyzed and analyzed. the hypothesis of the current research is that from the perspective of imami jurisprudence and iranian law, security in the field of health is a very important issue and one of the main duties of governance and governments is to support and strengthen it. our findings indicate that the mentioned right is considered as one of the fundamental human rights, so governments should take advantage of international cooperation and responsibility. acceptance regarding this human right, increase its executive capacity to ensure human security by benefiting the people of human societies from such a right. severe health inequalities can cause conflict and in the same way, military and armed conflicts threaten health and the health system in different ways. therefore, the cooperation of governments in solving health crises ensures the security of human health. the current research method is descriptive and analytical using library resources.
