تثبیت و صیانت از مالکیت خصوصی در مناطق آزاد تجاری - صنعتی و مناطق ویژه اقتصادی

مالکیت از جمله حقوق مورد تاکید و احترام دین اسلام است که در قرآن، روایات و سیره معصومین به آن اشاره شده است. در حقوق ایران با وجود حمایت نسبی از مالکیت خصوصی، اما در برخی قوانین و مقررات محدودیتهایی در این میان وجود دارد که احترام کامل آن را کم رنگ کرده است از جمله اصول 22 و 47 قانون اساسی. با این وجود برخی بی عدالتی ها که منشا آنها دستورات غیرقانونی برخی مقامات اداری می باشد موجب نادیده گرفتن مالکیت مشروع شهروندان شده است. این اتفاقات بنا به اقتضای مورد در مناطق آزاد تجاری و ویژه اقتصادی بیشتر گزارش شده است. در این حالت این نهادها برای تامین املاک خویش به طور مکرر دست روی اموال غیرمنقول شهروندان این مناطق خصوصاً بومیان قدیمی مناطق آزاد تجاری می گذارند. این در حالی است که مالکیت مشروع شهروندان مورد تاکید قانونگذار قرار گرفته شده است. در این پژوهش که به روش توصیفی تحلیلی گردآوری شده است یافته ها نشان می دهد در مناطق آزاد تجاری و مناطق ویژه اقتصادی، با برخی اقدامات ناصحیح، حقوق اقتصادی شهروندان از جمله مالکیت خصوصی شهروندان بر املاک و مستغلات به درستی مورد تثبیت، حمایت و صیانت قانونی قرار نگرفته است.

stabilization and protection of private property in commercial-industrial free zones and special economic zones

ownership is one of the rights emphasized and respected by islam, which is mentioned in the qur'an, hadiths, and the lives of the innocents. in iranian law, despite the partial protection of private property, there are limitations in some laws and regulations that have dimmed its full respect, including principles 22 and 47 of the constitution. however, some injustices, which originate from the illegal orders of some administrative officials, have caused citizens to ignore their legitimate property. these incidents are more reported in free trade and special economic zones, depending on the case. in this case, these institutions repeatedly seize the immovable property of the citizens of these areas, especially the old natives of the free trade zones, to secure their properties. this is while the legitimate ownership of citizens has been emphasized by the legislator. in this research, which has been compiled using a descriptive and analytical method, the findings show that in free trade zones and special economic zones, with some incorrect measures, the economic rights of citizens, including the private ownership of citizens on real estate and real estate, are properly established, supported and protected. it is not legal.
