رفاه اجتماعی در توسعه پایدار ازمنظر حقوق عمومی

توسعه پایدار با هدف بر طرف کردن احتیاجات انسانی و بهبود کیفیت زندگی، به عنوان قالب مناسب برای نگرش به نحوه مناسب بهره برداری از منابع با عنصر استمرار و پایداری در تامین رفاه انسان فعلی بدون آسیب رسانی به توانایی نسلهای بعدی در بر آوردن رفاه خود محسوب می شود. در این مقوله حقوق عمومی بعنوان قاعده آمره با شفاف سازی در عمل حکمرانی وایجاد یک نظم حقوقی در تامین رفاه اجتماعی ، عدالت توزیعی ،ایجاد پدیده مشارکت بین دولت وجامعه وحفظ محیط زیست ایفای نقش می کند. هدف این پژوهش بررسی رفاه اجتماعی در توسعه پایدار از منظر حقوق عمومی است که با روش کتابخانه ای و تحقیق توصیفی - تحلیلی انجام و سعی شده به این پرسش پاسخ داده شود که حقوق رفاه اجتماعی در توسعه پایداربه چه ترتیبی بوده و با چه مدلی می توان حقوق رفاه اجتماعی را درابعاد توسعه پایدار مطرح کرد. در این بررسی حقوق رفاه اجتماعی در توسعه پایدارناشی از تعهد فوری دولت به تامین حداقل حقوق رفاه اجتماعی بصورت پایداروحق انتخاب آزادعموم برای استفاده از کالاهای اولیه و تبدیل آن به رفاه اجتماعی است که با اتخاذ تدابیر حقوقی،همیاری دولت و جامعه وشرایط وامکانات دردسترس این تعهد روبه تزاید است. این نظم حقوقی در توسعه پایدار خود را تحت مدل محتوایی سه بعدی مطرح می کند.

the effect of social welfare on sustainable development from public law perspective

sustainable development with the aim of eliminating human needs and improving the quality of life, as a suitable format for an attitude towards the appropriate way of exploiting resources, with the element of continuity and sustainability, it is considered to provide the current human welfare without harming to the ability of future generations to achieve their welfare. in this category, public law as a rule of binding by clarifying the practice of governance and establishing a legal order in providing social welfare, distributive justice, creating the phenomenon of partnership between the government and society and environmental protection plays a role. the purpose of this research is to investigate social welfare in sustainable development from the perspective of public law. this research was done by library method and descriptive-analytical research and tried to answer this question of what is the order of social welfare rights in sustainable development and with what model can social welfare rights be raised in the dimensions of sustainable development? in this study, social welfare rights in sustainable development comes from the immediate commitment of the government to provide minimum social welfare rights in a sustainable manner and the right of the public to freely choose to use primary goods and transform it into social welfare. with the adoption of legal measures, the cooperation of the government and society, the available conditions and facilities this commitment is increasing. this legal system in the sustainable development presents itself under the three-dimensional content model.
