بررسی اصل رفاه اجتماعی در حقوق ایران و ارتباط آن با سایر حق های بشری

رفاه اجتماعی تعبیری است معطوف به وضعیت اقتصادی، اجتماعی و سیاسی که حفظ کرامت انسانی و مسئولیت‌پذیری افراد جامعه، در قبال یکدیگر و ارتقای توانمندی‌ها، از اهداف آن است. رفاه اجتماعی در هر جامعه از اساسی‌ترین نیازهای اجتماعی است که افراد جامعه باید از آن برخوردار باشند. در واقع یکی از وظایف اصلی هر دولتی تامین رفاه شهروندان است. از دیدگاه حقوقی تاثیر اصل رفاه اجتماعی در نظام حقوقی کشورها را می‌توان هم در سطح کلان و هم در سطح خرد مورد بررسی قرار داد. در حمایت از حقوق شهروندی، می‌توان به فعالیت های موثر و مفید کمیسیون حقوق بشر اسامی، دیوان عدالت اداری، سازمانهای بازرسی کل کشور و نیز، کمیسیون اصل 90 مجلس و تاسیس یک نهاد ملی (ماده 99 قانون شهروندی) که وظیفه آن، آموزش و ترویج حقوق شهروندی، اطلاع رسانی داخلی و بین المللی و نیز حمایت از فرد و جامعه جهت اجرای دقیق و کامل حقوق شهروندی و نظارت بر اجرای قانون حقوق شهروندی و بررسی شکایات دریافتی است، اشاره کرد. نتایج تحقیق حاضر نشان می‌دهد رفاه اجتماعی در حقوق ایران، با سایر حق های بشری در ارتباط است، ودر محورهای مختلف مدنی، اقتصادی، اجتماعی، سیاسی، فرهنگی، حق بر غذا، مسکن و پوشاک و.... ظاهر می‌گردد. ایجاد رفاه اجتماعی موجبات رضایت شهروندان را فراهم می آورد. سوال اصلی این است که شاخص‌های رضایت شهروندان براساس منشور حقوق شهروندی چیست؟ در این پژوهش روش تحقیق توصیفی-تحلیلی می باشد.

social welfare is an interpretation aimed at the economic, social and political situation, which aims to preserve human dignity and the responsibility of society members towards each other and to improve their abilities. social welfare in any society is one of the most basic social needs that society members should enjoy. in fact, one of the main duties of any government is to ensure the welfare of citizens. in support of citizenship rights, we can refer to the effective and useful activities of the human rights commission of esami, the court of administrative justice, the inspection organizations of the country as well as the commission of article 90 of the parliament and the establishment of a national institution (article 99 of the citizenship law) whose duty is education and promotion of citizenship rights, domestic and international information, as well as support for the individual and society for the accurate and complete implementation of citizenship rights, monitoring the implementation of the citizenship rights law and investigating the complaints received, he pointed out. the results of the present research show that social welfare in iranian law is related to other human rights, and it appears in various civil, economic, social, political, cultural axes, the right to food, housing and clothing, etc. be made the creation of social welfare causes the satisfaction of citizens. the main question is what are the indicators of citizens' satisfaction based on the charter of citizen rights? in this research, the research method is descriptive-analytical.
