تدوین استراتژی بهبود حقوق مبنایی کارگران پتروشیمی در مناطق آزاد به روش swot-ahp

در ﻣﺒﺎﺣﺚ ﻣﺮﺑﻮط ﺑﻪ ﺣﻘﻮق ﻛﺎر، ﻣﺎﻧﻨﺪ ﻫﺮ ﻣﻘﻮﻟﻪ ﺣﻘﻮق ﺑﺸﺮی دﻳﮕﺮ، ﻧﻴﺎزﻣﻨﺪ ﻃﺮاﺣﻲ ﻧﻈﺮﻳﻪ ای در ﺑﺎب ﺣﻖ ﻫﺎ ﻣﻲ ﺑﺎﺷﻴﻢ. ﻧﻈﺮﻳﻪ ای ﻛﻪ ﺑﺮ ﺿﺮورت و اﻟﺰام اﺧﻼﻗﻲ و ﺣﻘﻮﻗﻲ ﻣﻘﺮرات ﻛﺎر ﺗﺄﻛﻴﺪ داﺷﺘﻪ ﺑﺎﺷﺪ و ﺗﻮﺟﻴﻪ ﻛﻨﻨﺪه وﺟﻮد و ارزش ﻗﻮاﻋﺪ و اﺻﻮل ﺑﻨﻴﺎدﻳﻦ ﻛار که پایه ای این مقاله بر آن استوار است؛ عبارتند از ؛ منع ﺗﺒﻌﻴﺾ در اﺳﺘﺨﺪام، تساوی در ﻣﺰد ﺑﺮای ﻛﺎر ﺑﺎ ارزش ﺑﺮاﺑر، حداﻗﻞ ﺳﻦ ﻛﺎر ﻛﻮدک و لغو ﻛﺎر اﺟﺒﺎری می باشد.برای بهبود اصول مذکور در شرکت پتروشیمی در مناطق آزاد اقدام به بکارگیری یک روش خلاقانه مدیریتی کردیم. در واقع علم مدیریت راهکارهای را جهت بهبود اجرای اصول بنیادین حقوق کار می دهد. به همین جهت ابتدا چشم اندازها ، ارزش ها، تهدیدات و قوت های قوانین کار در مناطق آزاد را تبیین کرده و براساس جداول ماتریسیی ارزش گذاری می کنیم . با بررسی صورت گرفته با روش swot-ahp به نتایج جالبی رسیدیم که در صورتی که رویکرد استراتژی های برای کارگران پتروشیمی مناطق آزاد باید به ضرورت در تجدید نظر در قوانین مربوط به هیات رسیدگی در خصوص نحوه تجدید خواهی و نحوه بیان درخواست از سوی کارگران و همچنین تمهیداتی در خصوص نحوه رسیدگی به پرونده های کارگران اقدامات لازم صورت گیرد. همچنین باید الزام کارفرمایان در خصوص مکتوب بودن در خواست های کارگران در زمان عقد قرارداد و با در نظر گرفتن حقوق کارگران در زمینه قرارداد در مواجه با هرگونه تغییر در شرایط محیطی کار تمهیداتی اندیشیده شود.

providing a solution to improve the basic rights of petrochemical workers based on public rights through management methods

in the discussion related to labor rights, like any other human rights category, we need a theoretical design about rights. a theory that emphasizes the necessity and moral and legal requirements of work regulations and justifies the existence and value of the basic rules and principles of work on which the foundation of this article is based; as follows ; prohibition of discrimination in employment, equal pay for work of equal value, minimum working age for children and abolition of compulsory work. to improve the aforementioned principles in the petrochemical company in the free zones, we applied a creative management method. in fact, management science provides solutions to improve the implementation of the fundamental principles of rights. for this reason, we first explain the prospects, values, threats and strengths of labor laws in free zones and evaluate them based on matrix tables. with the investigation carried out with the swot-ahp method, we reached interesting results that if the approach of strategies for petrochemical workers in free zones must be revised in the laws related to the hearing board regarding the way of appeal and the way of expressing the request from the workers and also, arrangements should be made regarding the handling of workers' cases. employers should also consider requiring workers' requests to be in writing at the time of signing the contract and taking into account the rights of workers in the context of the contract in the face of any changes in the work environmen
