   تحلیل انتقادی دیدگاه اندیشمندان اسلامی درباره گسترۀ مشورت و حکم آن در قرآن

چکیده    مشروعیت شورا به عنوان یک اصل عقلایی و ضروری مورد پذیرش تمامی صاحب‌نظران است. در این میان، پرسش جدی آن است که آیا نظریه حاصل از مشورت تعهدآور بوده‏ و عمل به آن بر حاکم یا بر امت واجب‏ است؟ یا این‏که مشورت الزام‏آور نیست و تنها براى آشنا شدن با نظر مردم و خشنود کردن دل آن‏ها صورت می‌پذیرد. برخی بر این باورند از آنجا که در قرآن مضمون قاطع و محکمى وجود ندارد، نمی‌توان بر لازم الاجرا بودن نتایج مشورت حکم کرد. در این میان، آنچه بیش از پیش بر اختلاف مفسّران در زمینه محدوده شورا افزوده است تبیین واژه «امر» در آیه 38 شورا و 159 آل عمران است. حال آنکه با بررسی ظهور آیات ناظر به ساحت‌های چهارگانۀ مشورت در قرآن پی می‌بریم، مشورت، امری ارشادی و به مثابۀ توصیه اخلاقی و مستحب محسوب نمی‌شود. همچنین با تفکیک محدودۀ مشورت درمی‌یابیم که مشورت فقط در اموری جایز است که حکم الزام‌آوری در دین وجود ندارد. چنان‌که پیامبر (ص) بر پایه آیۀ ناظر به ساحت حکومتی، در امور غیر تنصیصی برای ترویج فرهنگ مشارکت با مردم مشورت نموده و ضرورت آن را به نوعی به مردم تعلیم داده است. در مقابل، در امور تنصیصی و احکام خاص و تغییرناپذیر چه در مرحله تصمیم‌سازی و چه مرحله تصمیم‌گیری، ملزم به مشورت نبوده اند.

   critical analysis of the view of islamic thinkers about the extent of consultation and its ruling in the qur'an

Abstract    legitimacy of the council as a rational and necessary principle is accepted by all experts. in the meantime, the serious question is whether the theory resulting from the consultation is binding and its implementation is obligatory on the ruler or on the ummah. or that consultation is not binding and is done only to get to know people's opinion and please their hearts. some people believe that since there is no firm content in the qur'an, it is not possible to rule on the validity of the consultation results. in the meantime, what has added to the disagreement of commentators regarding the scope of shura is the explanation of the word order in verse 38 of shura and 159 of al imran. however, byexamining the appearance of verses referring to the four areas of consultation in the qur'an, consultation is not considered as a matter of guidance and moral advice. also, by distinguishing the scope of consultation, we find that consultation is permissible only in matters that do not have a binding ruling in religion. as the prophet (pbuh) consulted with the people in non essential matters to promote the culture of participation and taught the people the necessity of it in a way, based on the verse regarding the governmental sphere. on the other hand, they were not required to consult in matters of classification and specific and unchangeable rulings, whether in the decision making or the decision making stage.
