دلایل تعارضات و راهکار‌های حل آن‌ها در پروژه‌های ساخت مشارکت عمومی‌ خصوصی

امروزه برای پیشرفت یک کشور از لحاظ زیرساختی به سرمایۀ زیادی نیاز است که از توان بخش دولتی به‌تنهایی خارج است. یکی از بهترین روش‌های بهره‌گیری از ظرفیت‌های بخش خصوصی در این راستا، مشارکت بخش دولتی با بخش خصوصی است. قرارداد‌های مشارکت عمومی خصوصی به علت اینکه معمولاً شامل یک توافق‌نامۀ بلندمدت با ترکیبات قانونی پیچیدۀ بسیار زیاد و تعداد زیادی ذی‌اثران مختلف با علایق، باور‌ها و اهداف متفاوت است، برای بروز تعارض به‌نسبت سایر انواع قرارداد‌های ساخت پتانسیل بیشتری دارد. هدف این پژوهش، یافتن مهم‌ترین دلایل بروز تعارضات در پروژه‌های مشارکت عمومی‌ خصوصی و همچنین شناسایی بهترین شیوۀ حل تعارضات است. در همین راستا، با بررسی ادبیات موضوع و کمک خبرگان تعدادی از عوامل تعارض در صنعت ساخت و به‌ویژه قرارداد‌های مشارکت عمومی‌   خصوصی و همچنین راهکار‌های حل تعارضات شناسایی شدند. در ادامه با کمک پرسش‌نامه از متخصصان درمورد اهمیت هرکدام از عوامل شناسایی‌شده و همچنین بهترین راهکار حل تعارضات نظرسنجی صورت گرفت. با بررسی نتایج حاصله، «برنامه‌ریزی نامناسب، تغییرات زیاد قرارداد و شفاف‌نبودن قوانین» مهم‌ترین عوامل و همچنین «مذاکره» بهترین شیوۀ حل تعارضات معرفی شدند.

causes of conflict and conflict resolution mechanisms in public-private partnership construction projects

for development of countries in terms of infrastructure, it requires a lot of capital, which is beyond the capacity of the public sector alone. one of the best ways to use the capacity of the private sector in this regard is the partnership of the public sector with the private sector. public-private partnership due to the long-term agreement with very complex legal compositions and multiplicity of stakeholders with varying beliefs and interests have a higher potential for conflict than other types of contracts. the purpose of this study is to find the most important causes of conflicts in public-private partnership projects and also to identify the best way to resolve conflicts. in this regard, by reviewing the literature and the help of experts, a number of conflict factors in the construction industry, especially public-private partnership contracts, as well as conflict resolution solutions were identified. then, with the help of a questionnaire from experts about the importance of each of the identified factors and also the best solution for resolving conflicts, a survey was conducted. examining the results, &improper planning, excessive contract changes and lack of transparency of laws& were introduced as the most important factors and also negotiation as the best way to resolve conflicts.
