واکنش‌های غیرکیفری در تقنین؛ مطالعه موردی صدور چک پرداخت‌نشدنی

چک مقبول‌ترین سند تجاری در جامعه است، سهولت در دسترسی به آن موجب افزایش استفاده از آن در معاملات شده است. صدور روز افزون چک‌های پرداخت‌نشدنی قانون‌گذار را ناگزیر به پیش‌بینی ضمانت-اجرای کیفری در مقابله با این چک‌ها نمود، اما جرم‌انگاری صدور چک پرداخت‌نشدنی نیز از گسترش صدور چک‌های پرداخت نشدنی نکاست. قانون‌گذار در ادوار مختلف قانون‌گذاری سعی در اصلاح قانون صدور چک نمود. اصلاحیه‌های گوناگون که در هر دهه در حوزه قانون چک تصویب می‌شد نیز نتوانست از افزایش صدور چک‌های پرداخت‌نشدنی جلوگیری کند. از این‌رو قانون‌گذار در اصلاحیه سال 1397 اقدام به اتخاذ تدابیر غیرکیفری در قبال صدور چک پرداخت‌نشدنی نمود پژوهش پیش‌رو با روش توصیفی-تحلیلی و مطالعه کتابخانه‌ای، در پی بررسی ماهیت و فلسفه واکنشهای غیرکیفری و نیز ضرورت رهنمونی به این واکنشها در خصوص صدور چک پرداخت‌ناشدنی و شناسایی این تدابیر در آخرین نسل از تدابیر قانونگذاری مقنن است.

a check is the most widely accepted commercial document in society, and its easy accessibility has led to increased use in transactions. the escalating issuance of dishonored checks has compelled legislators to anticipate criminal sanctions to combat these checks. however, criminalizing the issuance of dishonored checks did not deter their proliferation. over different periods, legislators attempted to amend check issuance laws to stabilize the legal framework. nevertheless, various amendments in each decade could not prevent the increase in the issuance of dishonored checks.consequently, in the 2018 amendment, lawmakers took non-criminal measures against the issuance of dishonored checks, attempting to prevent their issuance rather than solely relying on criminal prosecution. this advanced research, using a descriptive-analytical method and a library study, aims to investigate the nature and philosophy of non-criminal responses and the necessity of guidance to these responses regarding the issuance of dishonored checks. it identifies these measures in the latest generation of legislative measures. among the results, it is crucial to emphasize the need for a balanced approach by lawmakers in dealing with the issuance of dishonored checks, focusing on preventive actions rather than solely emphasizing criminalization or intensifying punitive policies. in this context, legal and banking measures can be considered appropriate non-criminal measures
