چالش‌ها و راهکارهای اِعمال کیفر حبس در قبال محکومین گروه‌های انحرافی

هدف پژوهش: تبیین چالشهای ناشی از اعمال مجازات حبس برای زندانیانِ محکوم تحت عنوان مجرمانه «فعالیت آموزشی یا تبلیغی انحرافی مُغایر یا مُخلّ به شرع مقدس اسلام» (مصوب 1399) و ارائه راهکارهای تعدیلکننده برای این چالشها. روش پژوهش: این پژوهش با روش توصیفی-تحلیلی انجام شده است.یافته‌ها: مطالعه نشان میدهد که مهمترین چالشهای مجازات حبس برای این دسته از زندانیان عبارتند از:جرم‌زایی محیط زندان. 2- تاثیر سوء بر فرآیند جامعه‌پذیری زندانی.3-  تاثیر سوء بر اقتصاد خانواده و جامعهدر پاسخ به این چالشها، راهکارهای زیر شناسایی شد: 1-  برای چالش جرم‌زایی زندان: تدابیر اقناعی و راهکارهای مبتنی بر طبقه‌بندی تخصصی زندانیان. 2-  برای چالش اختلال در جامعه‌پذیری: راهکارهای حمایتی با رویکرد روان‌شناختی. 3-  برای چالش اقتصادی: راهکارهای حمایتی با رویکرد اقتصادی. نتیجه‌گیری: ارزیابی این راهکارها در مقایسه با «آئین‌نامه اجرایی سازمان زندان‌ها مصوب 1400» نشان میدهد که علیرغم وجود مولفه های مثبت، این آئین‌نامه دارای کاستی های مهمی در زمینه تعدیل چالشهای حبس برای زندانیان انحرافی است. مهمترین این کاستیها عبارتند از: 1- فقدان مقررات خاص برای راهکارهای اقناعی مربوط به این زندانیان. 2- عدم وجاهت تخصصی در تصمیمات شورای طبقه بندی زندان. 3- سکوت در مورد راهکارهای روان‌شناختی-مباحثهای.4-  جواز ضمنی برای مداخله دادن عقیده زندانیان در برخورداری آنها از حقوق عادلانه.

challenges and solutions for imposing prison sentences on convicted members of deviant groups

research objective: to explain the challenges arising from the imposition of imprisonment for prisoners convicted under the criminal title of deviant educational or propaganda activity contrary to or contrary to the holy law of islam (approved in 1399) and to provide mitigating solutions for these challenges.research method: this research was conducted using a descriptive-analytical method.findings: the study shows that the most important challenges of imprisonment for this category of prisoners are:criminalization of the prison environment. 2- adverse impact on the prisoner's socialization process. 3- adverse impact on the family and community economyin response to these challenges, the following solutions were identified:1- for the challenge of criminalization of prison: persuasive measures and solutions based on specialized classification of prisoners.2- for the challenge of impaired socialization: support solutions with a psychological approach.3- for the economic challenge: support solutions with an economic approach.conclusion: an evaluation of these strategies in comparison with the executive regulations of the prisons organization approved in 1400 shows that despite the presence of positive components, this regulation has significant shortcomings in the field of mitigating the challenges of imprisonment for deviant prisoners. the most important of these shortcomings are: 1- the lack of specific provisions for persuasive strategies related to these prisoners. 2- the lack of specialized relevance in the decisions of the prison classification council. 3- silence on psychological-debate strategies. 4- implicit permission to interfere with the prisoners' beliefs in their enjoyment of fair rights.
