آسیب شناسی سیاست جنایی در جرایم اقتصادی با رویکرد به فضای مجازی

هدف: یکی از اهداف این رساله، آسیب‌شناسی رویکرد سیاست جنایی ایران در قبال جرایم اقتصادی است. همچنین، بررسی تاثیرات گسترش این جرایم که مانع دستیابی دولت به اهداف ملی در حوزه امنیت اقتصادی شده و امنیت عمومی را به مخاطره می‌اندازد، مدنظر قرار گرفته است.روش پژوهش: این پژوهش با رویکردی توصیفی - تحلیلی و با بررسی اسناد و قوانین موجود در حوزه جرایم اقتصادی و سیاست جنایی ایران صورت پذیرفته است.یافته‌ها: یافته‌ها نشان می‌دهد که فقدان تعریف مشخص از جرایم اقتصادی، مراجع تقنینی متعدد، تکثرگرایی در سیاست جنایی قضایی، رویکرد عوام‌گرایانه کیفری، فقدان سیاست جنایی منسجم و واحد، و امنیت‌مداری سیاست جنایی از جمله چالش‌ها و آسیب‌های موجود در سیاست جنایی فعلی ایران در قبال جرایم اقتصادی است. همچنین، شتاب‌زدگی قانون‌گذار در تدوین قوانین مرتبط با فساد اقتصادی مانع شکل‌گیری یک سیاست کیفری منسجم و قاطع شده است.نتیجه‌گیری: سیاست تقنینی ایران که عمدتاً مبتنی بر ویژگی‌های ارعابی، سزادهی و کیفرگرایی است، نمی‌تواند به‌عنوان یک سیاست جنایی موثر و مهارکننده پدیده بزهکاری، به‌ویژه فساد در نظام اقتصادی، عمل کند. برای مقابله کارآمد با جرایم اقتصادی، نیاز به تدوین یک سیاست جنایی منسجم، عقلانی و مبتنی بر ظرفیت‌های اقتصادی جامعه احساس می‌شود.

an analysis of criminal policy flaws in economic crimes with a focus on cyberspace

objective: one of the objectives of this dissertation is to analyze the flaws and challenges within iran''s criminal policy approach towards economic crimes. additionally, it aims to examine the impacts of the proliferation of such crimes, which hinder the government''s achievement of national objectives in the realm of economic security and jeopardize public security.method: this research has been conducted using a descriptive-analytical approach, through an examination of existing documents and legislation within the domain of economic crimes and iran''s criminal policy.results: the findings indicate that the lack of a clear definition for economic crimes, the multiplicity of legislative authorities, pluralism in judicial criminal policy, a populist punitive approach, the absence of a coherent and unified criminal policy, and the security-oriented nature of the criminal policy are among the challenges and shortcomings present in iran''s current criminal policy regarding economic crimes. furthermore, the legislature''s hastiness in drafting laws related to economic corruption has impeded the formation of a coherent and decisive penal policy.conclusions: iran''s legislative policy, which is primarily based on deterrent, retributive, and punitive characteristics, cannot function as an effective criminal policy capable of curbing delinquency, particularly corruption within the economic system. to efficiently combat economic crimes, there is a perceived need to formulate a coherent, rational criminal policy that is grounded in the economic capacities of society.
